Without there being any need to rule on whether the Civil Service Tribunal could none the less make such an order under Article 24 of the Statute of the Court of Justice, it must be held that such a possibility is provided for, at least in certain circumstances, in Article 44(2) of the Rules of Procedure of the Civil Service Tribunal, and Article 56 of those Rules is stated to be ‘without prejudice’ to Article 44(2).

Fifthly, the Civil Service Tribunal held, in consequence of the existence of those special circumstances, that although the communication to the applicant of the individual eliminatory mark, of 24.5 out of 50, which he received in the oral test constitutes more than merely the initial elements of a statement of reasons which, according to the case-law (Case T‑71/96 Berlingieri Vinzek v Commission [1997] ECR-SC I‑A‑339 and II‑921, paragraph 79), was susceptible of being supplemented by further information provided during the proceedings, that mark alone not being sufficient, in the particular circumstances, to satisfy fully the obligation to state reasons.

In the judgment under appeal, the Civil Service Tribunal noted, first, that the action must be held to be directed solely against the decision of 19 June 2007 on the ground that where a candidate in a competition seeks review of a decision taken by a selection board, it is the decision taken by the latter after the review of the candidate’s situation that constitutes the act adversely affecting him (paragraphs 19 and 20 of the judgment under appeal).
Par l’arrêt attaqué, le Tribunal de la fonction publique a, tout d’abord, constaté que le recours devait être considéré comme dirigé contre la seule décision du 19 juin 2007 au motif que, lorsqu’un candidat à un concours sollicite le réexamen d’une décision prise par un jury, c’est la décision prise par ce dernier après réexamen de la situation du candidat qui constitue l’acte lui faisant grief (points 19 et 20 de l’arrêt attaqué).

13. Commends the internal political and institutional reforms undertaken by Armenia following the constitutional reform and in the context of implementation of the ENP Action Plan; encourages the Armenian authorities to continue on this path and to make further progress in strengthening democratic structures, the rule of law and protection of human rights; calls, in particular, for further efforts to be made in establishing an independent judiciary, in promoting reforms in the police, the civil service and local government, in fighting corruption and in creating a vibrant civil society; notes the statement of the International Election Observation Mission that the parliamentary elections held in May 2007 were largely in accordance with international commitments; trusts that the Armenian authorities will work closely with the Organization for Security and Co-operation in Europe (OSCE) and the Council of Europe to address remaining issues in order to further improve the standards already attained and fully to guarantee the free and fair conduct of the presidential elections to be held on 19 February 2008; encourages, generally, the establishment of a constructive dialogue between the government and the opposition with a view to strengthening pluralism as the core element of democracy; further calls on the Armenian authorities to investigate allegations of violence and ill-treatment in police custody and penitentiary institutions and corruption and breaches of freedom of expression,

Regrets the lack of participation of non-governmental national and trans-national networks especially representative of women, mothers and young girls' associations as well as organisations dealing with sexual and reproductive health and rights in the first Civil Society Forum on Drugs held in December 2007; calls on the Commission to actively encourage the participation of such organisations as well as other organisations that have valuable experience relating to drugs and drug abuse in order to provide accessible and widely available specialised services;
16. regrette la non-participation de réseaux nationaux et transnationaux non gouvernementaux représentant notamment des associations de femmes, de mères et de jeunes filles, ainsi que d'organisations œuvrant dans le domaine de la santé et des droits sexuels et génésiques, au premier Forum de la société civile sur la drogue, qui s'est tenu en décembre 2007; invite la Commission à encourager activement la participation de telles organisations ainsi que celle d'autres organisations disposant d'une précieuse expérience tant en matière de drogues que de toxicomanie, afin de proposer, à large échelle, des services spécialisés accessibles;
