MINDFUL of the breadth of privacy protections in the United States of America (United States), as reflected in the United States Constitution, and in its criminal and civil legislation, regulations, and long-standing policies, which are enforced and maintained by checks and balances applied by the three branches of government.

In order to ensure a smooth transition and a high level of civil aviation safety in the Union, the Implementing Rules should reflect the state of the art and the best practices in the field of aerodromes; take into account the applicable International Civil Aviation Organization (hereinafter referred to as ‘ICAO’) Standards and Recommended Practices, thereby respecting ICAO’s respective classification throughout the system of rules; and worldwide aerodrome operation experience, and scientific and technical progress in the field of aerodromes; be proportionate to the size, traffic, category and complexity of the aerodrome and nature and volume of operations thereon; provide for the necessary flexibility for customised compliance; and cater for the cases of aerodrome infrastructure which has been developed, prior to the entry into force of this Regulation, in accordance with the different requirements contained in the national legislations of the Member States.
Afin d’assurer une transition progressive et un niveau élevé de sécurité de l’aviation civile au sein de l’Union, les modalités d’exécution rendent compte de l’état actuel de la technique et des bonnes pratiques dans le domaine des aérodromes; tiennent compte des normes et pratiques recommandées de l’Organisation de l’aviation civile internationale (ci-après dénommée «OACI»), et ce faisant respectent la classification pertinente de l’OACI à tous les niveaux du système de règles, ainsi que de l’expérience d’exploitation d’aérodromes partout dans le monde et des progrès scientifiques et techniques accomplis dans le domaine des aérodromes; sont proportionnées à la taille, au trafic, à la catégorie et à la complexité de l’aérodrome ainsi qu’à la nature et au volume des opérations qui y sont réalisées; confèrent la souplesse nécessaire pour une conformité cas par cas; et pourvoient aux besoins des infrastructures d’aérodrome développées avant l’entrée en vigueur du présent règlement, conformément aux différentes exigences contenues dans les législations nationales des États membres.

Two implementing rules complete this legislation: Commission Regulation (EC) No 1321/2007 (5), which establishes a European Central Repository (ECR) regrouping all civil aviation occurrences collected by Member States, and Commission Regulation (EC) No 1330/2007 (6), which lays down rules regarding the dissemination of the information contained in the ECR.
Deux règlements d’exécution complètent ladite législation: le règlement (CE) no 1321/2007 de la Commission (5), établissant le répertoire central européen (RCE) regroupant tous les évènements de l’aviation civile recueillis par les États membres, et le règlement (CE) no 1330/2007 de la Commission (6), fixant les règles concernant la diffusion des informations présentes dans le RCE.

Accordingly, Regulation (EEC) No 3922/91 as well as technical requirements and administrative procedures agreed by the International Civil Aviation Organisation (‘ICAO’) and the Joint Aviation Authorities until 30 June 2009, and existing legislation pertaining to a specific national environment, should be considered.

It is necessary to establish appropriate measures to ensure both the necessary protection of sensitive safety data and to provide the public with adequate information pertaining to the level of civil aviation safety and environmental protection relating thereto, taking into account Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents and relevant national legislation.

Council Directive 80/51/EEC of 20 December 1979 on the limitation of noise emissions from subsonic aircraft(6) and Annex II to Council Regulation (EEC) No 3922/91 of 16 December 1991 on the harmonisation of technical requirements and administrative procedures in the field of civil aviation(7) should therefore be repealed in due time, without prejudice to the certification of products, persons and organisations already performed in accordance with these legislative acts.

3. This Regulation shall apply to civil servants and to persons who, in accordance with the legislation applicable, are treated as such, where they are or have been subject to the legislation of a Member State to which this Regulation applies.
3. Le présent règlement s'applique aux fonctionnaires et au personnel qui, selon la législation applicable, leur est assimilé, dans la mesure où ils sont ou ont été soumis à la législation d'un État membre à laquelle le présent règlement est applicable.
