The regional air carriers believe that the a number of circumstances beyond an air carrier’s control should be considered force majeure when calculating adherence to the use-it-or-lose-it rule: weather conditions that affect operators of smaller aircraft more than others should be recognised as force majeure; flight cancellations due to industrial action and strikes; and, cumulative delays over a day caused by Air Traffic Management problems that result in cancellations.

Considers that a clear definition must be given for the most recurring terms which serve to establish the carrier’s liability and/or the appropriate rights for passengers, which includes the terms ‘flight’, ’re-routing’, ‘connection’, ‘diversion’, ‘cancellation’, ‘long delay’, ‘schedule’, ‘final destination’, ‘assistance and care’ and ‘right of redress’; highlights the need for a clear definition and Commission guidelines on what is covered by ‘extraordinary circumstances’, which should be clearly stated in future amendments of Regulation 261/2004, to prevent unjustified interpretations of the circumstances that have led to cancellations or delays; invites the Commission to reassess the unlimited liability of air carriers regarding the right to care under extraordinary circumstances beyond the carrier’s control;
10. considère qu'il est indispensable d'établir une définition claire des termes les plus récurrents servant à établir la responsabilité du transporteur et/ou les droits appropriés des passagers, notamment des termes "vol", "réacheminement", "correspondance", "déroutement", "annulation", "retard important", "horaire", "destination finale", "assistance et prise en charge" et "droit de recours"; souligne la nécessité d'une définition précise et d'orientations de la Commission quant à ce que recouvre le terme "circonstances exceptionnelles", qui devrait être clairement indiqué dans les futures modifications apportées au règlement (CE) n° 261/2004 afin d'empêcher toute interprétation injustifiée des circonstances qui ont entrainé des annulations ou des retards; invite la Commission à réévaluer la responsabilité illimitée des transporteurs aériens concernant le droit à une prise en charge dans des circonstances exceptionnelles échappant au contrôle du transporteur;
