IN-CONTEXT TRANSLATIONS

This report highlights the role of the Court of Justice of the European Union (the Court) in implementing the Charter, especially as regards the most recent development of its case law on the Charter’s applicability in Member States.
Le présent rapport met en évidence le rôle de la Cour de justice de l’Union européenne (la Cour) dans la mise en œuvre de la Charte, notamment en ce qui concerne la très récente évolution de sa jurisprudence relative à l’applicabilité de la Charte dans les États membres.

Considers that the institutions, agencies and other bodies of the European Union still fail to take fully into account of, and to comply with, the rules and the changes provided for in the Lisbon Treaty and the Charter of Fundamental Rights when applying Regulation (EC) No 1049/2001, especially as concerns participatory democracy; notes and welcomes the recent judgments of the Grand Chamber of the Court of Justice in the Digital Rights Ireland and Schrems cases, in both of which the Court based itself on the Charter when declaring invalid the Data Retention Directive and the Safe Harbour Decision , respectively; stresses that actual public access to documents and the management of registers of documents need to be based on standards that comply adequately with Articles 41 and 42 of the Charter.

Bearing in mind the European Energy Charter, the Declarations of the Lucerne Conference of April 1993 and of the Sofia Conference of October 1995, and taking into account the Energy Charter Treaty, and especially Article 19 thereof, and the Energy Charter Protocol on Energy Efficiency and related environmental aspects, the Parties shall develop and strengthen their cooperation on environment and human health.

(14) There is a need to step up Community efforts to promote dialogue and understanding between cultures world-wide, bearing in mind the social dimension of higher education as well as the ideals of democracy and respect for human rights, including gender equality, especially as mobility fosters the discovery of new cultural and social environments and facilitates understanding thereof, and in so doing to ensure that no group of citizens or of third-country nationals is excluded or disadvantaged as mentioned in Article 21(1) of the Charter of Fundamental Rights of the European Union.

(14) Whereas the Community Charter of the Fundamental Social Rights of Workers acknowledges the importance of combating all forms of discrimination, especially those based on sex, colour, race, opinions and beliefs;
