On 18 January 2013, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which IHI Corporation (‘IHI’, Japan) acquires within the meaning of Article 3(1)(b) of the Merger Regulation control of the whole of IHI Charging Systems International GmbH (‘ICSI’, Germany) by way of purchase of shares.
Le 18 janvier 2013, la Commission a reçu notification, conformément à l’article 4 du règlement (CE) no 139/2004 du Conseil (1), d’un projet de concentration par lequel l’entreprise IHI Corporation («IHI», Japon) acquiert, au sens de l'article 3, paragraphe 1, point b), du règlement CE sur les concentrations, le contrôle de l’ensemble de l’entreprise IHI Charging Systems International GmbH («ICSI», Allemagne) par achat d’actions.

Following this analysis, the Commission concluded that central banks and public bodies charged with or intervening in the management of public debt should be exempted from the clearing and reporting obligation applicable to over-the-counter (OTC) derivatives pursuant to the rules on OTC derivatives introduced in Japan and the United States of America.
À l’issue de cette analyse, la Commission a conclu que les banques centrales et les organismes publics chargés de gérer la dette publique ou intervenant dans sa gestion devraient être exemptés de l’obligation de compensation et de déclaration applicable aux produits dérivés de gré à gré conformément aux règles sur ces produits introduites au Japon et aux États-Unis.

Adding central banks and public bodies charged with or intervening in the management of the public debt from Japan and from the United States of America to the list of exempted entities referred to in Regulation (EU) No 648/2012 should promote neutral market conditions in the application of OTC derivatives reforms with regard to transactions with central banks across those jurisdictions and contribute to greater international coherence and consistency.
L’ajout des banques centrales et des organismes publics chargés de gérer la dette publique ou intervenant dans sa gestion au Japon et aux États-Unis à la liste des entités exemptées visée dans le règlement (UE) no 648/2012 devrait favoriser l’application, de manière neutre pour le marché, des réformes relatives aux produits dérivés de gré à gré pour ce qui est des opérations avec les banques centrales dans ces pays, et contribuer à une plus grande cohérence et à une plus grande uniformité à l’échelle internationale.

The complaint alleged that in November 1989 the Japan Harbour Transportation Association introduced a port charge on all cargoes moving through Japanese ports, the aim being to establish a Harbour Management Fund the alleged purpose of which was to ensure a stable, regular supply of dock labour and to update and modernize Japan's import distribution system.
