Definition: This category includes certain disorders of behaviour that are not classifiable under other categories. They are characterized by repeated acts that have no clear rational motivation, cannot be controlled, and generally harm the patient's own interests and those of other people. The patient reports that the behaviour is associated with impulses to action. The cause of these disorders is not understood and they are grouped together because of broad descriptive similarities, not because they are known to share any other important features.

Definition: The schizophrenic disorders are characterized in general by fundamental and characteristic distortions of thinking and perception, and affects that are inappropriate or blunted. Clear consciousness and intellectual capacity are usually maintained although certain cognitive deficits may evolve in the course of time. The most important psychopathological phenomena include thought echo; thought insertion or withdrawal; thought broadcasting; delusional perception and delusions of control; influence or passivity; hallucinatory voices commenting or discussing the patient in the third person; thought disorders and negative symptoms. The course of schizophrenic disorders can be either continuous, or episodic with progressive or stable deficit, or there can be one or more episodes with complete or incomplete remission. The diagnosis of schizophrenia should not be made in the presence of extensive depressive or manic symptoms unless it is clear that schizophrenic symptoms antedate the affective disturbance. Nor should schizophrenia be diagnosed in the presence of overt brain disease or during states of drug intoxication or withdrawal. Similar disorders developing in the presence of epilepsy or other brain disease should be classified under F06.2, and those induced by psychoactive substances under F10-F19 with common fourth character .5.

This raises serious concerns in respect of the rule of law, notably as a number of particularly sensitive new legislative acts have been adopted recently by the Sejm for which constitutional review should be available, such as, in particular, a media law, a law amending the law on the Police and certain other laws, a new Civil Service Act, a law on the National Council of Media and a new anti-terrorism law.

On 28 September 2005, the European Parliament adopted a resolution on the opening of negotiations with Turkey, in which Members of the European Parliament highlighted the basic problems causing serious difficulties to the negotiations, including: Turkey’s embargo on vessels flying the Cypriot flag; the Protocol signed by Turkey on 29 July 2005 and the statement released at the same time, i.e. the unresolved problem of the recognition of Cyprus; the fact that Turkey has not recognised the Armenian genocide, although this is considered by the EU to be a prerequisite for accession; the compatibility of the Turkish criminal code and of certain other laws with the European Convention for the Protection of Human Rights and Fundamental Freedoms; and issues relating to financial aid and trade facilitation with the northern part of Cyprus.

There have certainly been laws, ratified by those countries that want to, and which apply in some places and not in others; some doors open and others close, and it is this murky area in which a little law is mixed up with no law at all that gives rise to dubious dealings, tricks, skilful manoeuvres and escape from the authorities.

(5) In the absence of uniform rules at Community level, obstacles to cross-border services and goods or the freedom of establishment might be justified in the light of the case-law of the Court of Justice as long as they seek to protect recognised public interest objectives and are proportionate to those objectives; in the light of Community objectives, of the provisions of the Treaty relating to free movement, of secondary Community law, and in accordance with the Commission’s policy on commercial communications , such obstacles can only be eliminated by establishing uniform rules at Community level and by clarifying certain legal concepts at Community level to the extent necessary for the proper functioning of the Internal Market; other restrictions have been identified as requiring replacement by less restrictive measures; remaining restrictions relating to the use and communication of sales promotions should be submitted to the principle of mutual recognition of national legislation.
(5) En l'absence de dispositions uniformes au niveau communautaire, les obstacles à la libre prestation des services transfrontaliers et à la libre circulation des marchandises ou à la liberté d'établissement peuvent être justifiés au regard de la jurisprudence de la Cour de justice, s'ils visent à protéger des objectifs d'intérêt public reconnus et leur sont proportionnés.
