The programme is open to European Union (EU) countries and, provided that they meet certain conditions, EFTA countries, candidate and potential candidate countries to EU membership, and countries that are part of the EU neighbourhood policy area (Algeria, Armenia, Azerbaijan, Belarus, Egypt, Georgia, Israel, Jordan, Lebanon, Libya,Moldova, Morocco, Palestine, Syria, Tunisia and Ukraine).

WEEE exported out of the Community in line with Regulation (EC) No 1013/2006 on shipments of waste Council Regulation (EEC) No 259/93, and Commission Regulation (EC) No 1418/2007 of 29 November 2007 concerning the export for recovery of certain waste listed in Annex III or Annex IIIA to Regulation (EC) No 1013/2006 of the European Parliament and of the Council to certain countries to which the OECD Decision on the control of transboundary movements of wastes does not apply [26] Council Regulation (EC) No 1420/1999 [27] of 29 April 1999 establishing common rules and procedures to apply to shipments to certain non-OECD countries of certain types of waste and Commission Regulation (EC) No 1547/1999 [28] of 12 July 1999 determining the control procedures under Council Regulation (EEC) No 259/93 to apply to shipments of certain types of waste to certain countries to which OECD Decision C(92)39 final does not apply, shall only count for the fulfilment of obligations and targets of Article 117(1) and (2) of this Directive if the exporter can prove that the treatment recovery, re-use and/or recycling operation took place under conditions that are equivalent to the requirements of this Directive.
2. Les DEEE exportés de la Communauté conformément au √ règlement (CE) n° 1013/2006 concernant les transferts de déchets ∏ règlement (CEE) n° 259/93 du Conseil, √ et au règlement (CE) n° 1418/2007 de la Commission du 29 novembre 2007 concernant l’exportation de certains déchets destinés à être valorisés, énumérés à l’annexe III ou IIIA du règlement (CE) n° 1013/2006 du Parlement européen et du Conseil vers certains pays auxquels la décision de l’OCDE sur le contrôle des mouvements transfrontières de déchets ne s’applique pas[26] ∏ au règlement (CE) n° 1420/1999 du Conseil du 29 avril 1999 établissant les règles et procédures communes applicables aux transferts de certains types de déchets vers certains pays non membres de l'OCDE [27] et au règlement (CE) n° 1547/1999 de la Commission du 12 juillet 1999 déterminant les procédures de contrôle à appliquer, conformément au règlement (CEE) n° 259/93 du Conseil, aux transferts de certains types de déchets vers certains pays non soumis à la décision C(92)39 final de l'OCDE[28] ne comptent pour l'exécution des obligations et la réalisation des objectifs visés à l'article 117, paragraphes 1 et 2, de la présente directive que si l'exportateur est en mesure de prouver que l'opération de valorisation, de réutilisation et/ou de recyclage ? le traitement ⎪ s'est déroulée dans des conditions équivalentes aux exigences définies dans la présente directive.

3. This Regulation shall not affect the obligations of Member States arising out of special relations or future agreements with certain non-European countries or territories, based on institutional ties existing on 8 November 1968, or agreements in existence on 8 November 1968 with certain non-European countries or territories, based on institutional ties between them.

Whereas from a first examination of the information it has resulted that in certain of these countries production and inspection rules are applied which appear largely satisfy the requirement of equivalency provided for in Article 11 (2) of Regulation (EEC) No 2092/91; whereas however on certain points the examination has to be completed and studied in detail, with the consequence that the stage in examining the information does not permit a decision to be taken regarding the inclusion of these third countries in the list provided for in Article 11 (1) before 1 January 1993, the date of implementation of this provision;
considérant que, d'un premier examen des données, il résulte que dans certains de ces pays des règles de production et contrôle sont appliquées qui semblent largement satisfaire à l'exigence d'équivalence prévue à l'article 11 paragraphe 2 du règlement (CEE) no 2092/91; que néanmoins sur certains points l'examen doit être complété et approfondi, avec la conséquence que l'état de l'examen du dossier ne permet pas une prise de décision sur l'inclusion de ces pays tiers dans la liste visée à l'article 11 paragraphe 1 point a) de ce règlement, avant le 1er janvier 1993, date de la mise en application de cette disposition;
