Whereas, therefore, this Directive defines only the essential health and safety requirements of general application, supplemented by a number of more specific requirements for certain categories of machinery; whereas, in order to help manufacturers to prove conformity to these essential requirements and in order to allow inspection for conformity to the essential requirements, it is desirable to have standards harmonized at European level for the prevention of risks arising out of the design and construction of machinery; whereas these standards harmonized at European level are drawn up by private-law bodies and must retain their non-binding status; whereas for this purpose the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are the bodies recognized as competent to adopt harmonized standards in accordance with the general guidelines for cooperation between the Commission and these two bodies signed on 13 November 1984; whereas, within the meaning of this Directive, a harmonized standard is a technical specification (European standard or harmonization document) adopted by either or both of these bodies, on the basis of a remit from the Commission in accordance with the provisions of Council Directive 83/189/EEC of 28 March 1983 laying down a procedure for the provision of information in the field of technical standards and regulations (4), as last amended by Directive 88/182/EEC (5), and on the basis of general guidelines referred to above;

Whereas, however, with regard to certain epizootic diseases, different health situations still prevail in the Member States and whereas, pending a Community approach on the methods to combat these diseases, the question of checking intra-Community trade in livestock should for the time being be left to one side and a documentary check should be permitted during transport; whereas, in view of the current state of harmonization and pending Community rules, goods that are not the subject of harmonized rules should comply with the requirements of the State of destination provided that the latter are in conformity with Article 36 of the Treaty;

Measures relating to the matters set out below shall be adopted in accordance with the procedure defined in Article 10 : (a) application of the combined nomenclature and the Taric concerning in particular : - the classification of goods in the nomenclatures referred to in Article 8, -explanatory notes; (b)amendments to the combined nomenclature to take account of changes in requirements relating to statistics or to commercial policy; (c)amendments to Annex II; (d)amendments to the combined nomenclature and adjustments to duties in accordance with decisions adopted by the Council or the Commission; (e)amendments to the combined nomenclature intended to adapt it to take account of technological or commercial developments or aimed at the alignment or clarification of texts; (f)amendments to the combined nomenclature resulting from changes to the harmonized system nomenclature; (g)questions relating to the application, functioning and management of the harmonized system to be discussed within the Customs Cooperation Council. 2. The provisions adopted under paragraph 1 shall not amend : - the rates of customs duties, -agricultural levies, refunds or other amounts applicable within the framework of the common agricultural policy or within that of specific schemes applicable to certain goods resulting from the processing of agricultural products, -quantitative restrictions laid down under Community provisions, -nomenclatures adopted within the framework of the common agricultural policy.

This Directive aims to eliminate the tax obstacles to the temporary importation of certain means of transport within the Community by harmonizing national tax arrangements.

Whereas within the Community the free movement of electrical equipment should follow when this equipment complies with certain safety requirements recognized in all Member States ; whereas without prejudice to any other form of proof, the proof of compliance with these requirements may be established by reference to harmonized standards which incorporate these conditions ; whereas these harmonized standards should be established by common agreement by bodies to be notified by each Member State to the other Member States and to the Commission and should be publicized as widely as possible ; whereas such harmonization should for the purposes of trade eliminate the inconveniences, resulting from differences between national standards;
