I'm not denying there is enormous political importance to what the Supreme Court of Canada judges deny. It would be ludicrous to say it's not political in that dimension, but in fact the Canadian charter, which was produced with exceptional public participation and involvement and approval the only really domestic national Canadian constituent engagement we've ever had expressly gives the judges this mandate.
