Since, despite the introduction of a cap on charges within Europe, the average charges applied by operators are not far short of the caps imposed by legislation and are preventing healthy competition, the Commission says that it has been obliged to introduce a new legislative package proposing the abolition of surcharges for roaming calls received while abroad, whilst the other roaming charges are supposed to be phased out by encouraging competition between operators, or at least between alliances of operators.

This Regulation introduces a common approach to ensuring that users of public mobile communications networks when travelling within the Community do not pay excessive prices for Community-wide roaming services in comparison with competitive national prices, when making calls and receiving calls, when sending and receiving SMS messages and when using packet switched data communication services, thereby contributing to the smooth functioning of the internal market while achieving a high level of consumer protection, fostering competition and transparency in the market and offering both incentives for innovation and consumer choice.
Le présent règlement instaure une approche commune pour faire en sorte que les usagers des réseaux publics de communications mobiles qui voyagent à l’intérieur de la Communauté ne paient pas un prix excessif pour les services d’itinérance communautaire, par comparaison avec les prix nationaux concurrentiels, lorsqu’ils passent et reçoivent des appels, envoient et reçoivent des SMS et utilisent des services de communication de données par commutation de paquets, et contribuer ainsi au fonctionnement harmonieux du marché intérieur tout en garantissant un degré élevé de protection des consommateurs, en favorisant la concurrence et la transparence sur le marché et en offrant à la fois des incitations à l’innovation et un choix aux consommateurs.

“Community-wide roaming” means the use of a mobile telephone or other device by a roaming customer to make or receive intra-Community calls, to send or receive SMS messages, or to use packet switched data communications, while in a Member State other than that in which that customer's home network is located, by means of arrangements between the operator of the home network and the operator of the visited network.
“itinérance communautaire”, l’utilisation d’un téléphone portable ou d’un autre appareil par un abonné itinérant pour passer ou recevoir des appels à l’intérieur de la Communauté, envoyer ou recevoir des SMS ou utiliser des données par commutation de paquets lorsqu’il se trouve dans un État membre autre que celui où est situé son réseau d’origine, du fait de dispositions arrêtées entre l’opérateur du réseau d’origine et l’opérateur du réseau visité.

‘Union-wide roaming’ means the use of a mobile device by a roaming customer to make or receive intra-Union calls, to send or receive intra-Union SMS messages, or to use packet switched data communications, while in a Member State other than that in which the network of the domestic provider is located, by means of arrangements between the home network operator and the visited network operator;

In order to improve the transparency of retail prices for making and receiving regulated roaming calls within the Community and to help roaming customers make decisions on the use of their mobile telephones while abroad, providers of mobile telephony services should enable their roaming customers easily to obtain information free of charge on the roaming charges applicable to them when making or receiving voice calls in a visited Member State.
Afin d'accroître la transparence des prix de détail pour effectuer et recevoir des appels en itinérance réglementés à l'intérieur de la Communauté et d'aider les abonnés itinérants à prendre des décisions quant à l'utilisation de leur téléphone portable à l'étranger, les fournisseurs de services de téléphonie mobile devraient permettre à leurs abonnés itinérants d'obtenir facilement des informations gratuites sur les tarifs d'itinérance qui leur sont applicables lorsqu'ils passent ou reçoivent des communications vocales dans un État membre visité.
