Notwithstanding paragraphs 1 and 2, the retention on board, transhipment or landing of specimens of marine species referred to in paragraph 1 which have been caught as bycatch, shall be authorised as far as this activity is necessary to secure assistance for the recovery of the individual animals and provided that the competent national authorities concerned have been fully informed in advance.

In order to ensure a coherent approach between the internal and external EU fisheries policy for seabirds, the Union will seek that the relevant international bodies enhance these measures by facilitating their adoption by fishermen, integrating seabird bycatch monitoring into observer programmes (where this has not already been achieved) and promoting best practice to non-EU fleets. The Long Distance Fleet Regional Advisory Council (LDRAC) has a clear role in assisting with this task.
Afin d’assurer une approche cohérente entre les dimensions interne et externe de la politique de la pêche menée par l'UE, l'Union veillera à ce que les organismes internationaux compétents renforcent ces mesures en facilitant leur adoption par les pêcheurs, en intégrant un suivi des prises accessoires d'oiseaux marins dans les programmes d'observation (si cela n'est pas encore fait) et en promouvant les meilleures pratiques dans les flottes non UE. Le conseil consultatif régional pour la flotte en haute mer/pêche lointaine a sans conteste un rôle important à jouer dans l'exécution de cette tâche.
