At the level of secondary legislation, the present communication is to be seen in the context of the ".Television without frontiers " Directive, which aims to coordinate certain provisions laid down by law, regulation or administrative action in Member States concerning the pursuit of television broadcasting activities, and in the context of Directive 80/723/EEC on the transparency of financial relations between Member States and public undertakings as well as on financial transparency within certain undertakings.
Au niveau de la législation dérivée, la présente communication s'insère dans le contexte de la directive « Télévision sans frontières », qui vise à la coordination de certaines dispositions législatives, réglementaires et administratives des États membres relatives à l'exercice d'activités de radiodiffusion télévisuelle, et de la directive 80/723/CEE relative à la transparence des relations financières entre les États membres et les entreprises publiques ainsi qu'à la transparence financière dans certaines entreprises.

Since its inception, television broadcasting has been provided mostly by public undertakings under a monopoly regime, mainly as a consequence of the limited availability of broadcasting frequencies and the high barriers to entry.
Depuis ses débuts, l'activité radiodiffusion télévisuelle a été, dans la plupart des cas, exercée par des entreprises publiques sous un régime de monopole, en raison, principalement, du nombre limité de fréquences de radiodiffusion disponibles et des importants obstacles à l'entrée.

Member States may impose reasonable “must carry” obligations, for the transmission of specified radio and television broadcast channels and complementary services, particularly accessibility services to enable appropriate access for disabled end-users, on undertakings under their jurisdiction providing electronic communications networks used for the distribution of radio or television broadcast channels to the public where a significant number of end-users of such networks use them as their principal means to receive radio and television broadcast channels.
Les États membres peuvent imposer des obligations raisonnables de diffuser (“must carry”) pour la transmission de chaînes de radio et de télévision spécifiées et de services complémentaires, notamment les services d’accessibilité destinés à assurer un accès approprié pour les utilisateurs finals handicapés, aux entreprises relevant de leur ressort qui fournissent des réseaux de communications électroniques utilisés pour la diffusion publique de chaînes de radio et de télévision, lorsqu’un nombre significatif d’utilisateurs finals utilisent ces réseaux comme leur moyen principal pour recevoir des chaînes de radio et de télévision.
