5. Nothing in this Direction shall be construed as limiting the power of the Governor in Council to direct that broadcasting licences may not be issued and amendments or renewals of broadcasting licences may not be granted to applicants of a class other than a class described in section 3 or as limiting the power of the Commission, in carrying out its objects, to refuse to issue a broadcasting licence or to grant an amendment or renewal of a broadcasting licence to an applicant of a class other than a class described in section 3.
5. Les présentes instructions n’ont pas pour effet de limiter le pouvoir du gouverneur en conseil de restreindre l’attribution, la modification ou le renouvellement des licences de radiodiffusion dans le cas des requérants d’une classe autre que celle définie à l’article 3, ni de limiter le pouvoir du Conseil, dans la poursuite de ses objets, de refuser d’attribuer, de modifier ou de renouveler des licences de radiodiffusion dans le cas des requérants d’une classe autre que celle définie à l’article 3.

Her Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to subparagraph 22(1)(a)(iii) and section 27 of the Broadcasting Act, is pleased hereby to revoke the Direction to the CRTC (Ineligibility to Hold Broadcasting Licences), C.R.C., c. 377, and to make the annexed Order issuing a Direction to the Canadian Radio-television and Telecommunications Commission respecting ineligibility to hold broadcasting licences, in substitution therefor.
Sur avis conforme du ministre des Communications et en vertu du sous-alinéa 22(1)a)(iii) et de l’article 27 de la Loi sur la radiodiffusion, il plaît à Son Excellence le Gouverneur général en conseil d’abroger les Instructions au CRTC (Inhabilité à détenir des licences de radiodiffusion), C.R.C., ch. 377 et de prendre en remplacement le Décret sur les Instructions à l’intention du Conseil de la radiodiffusion et des télécommunications canadiennes concernant l’inadmissibilité aux licences de radiodiffusion, ci-après.

(5) Every broadcasting licence authorizing the carrying on of a broadcasting undertaking issued under the former Act and in effect on the day immediately preceding the coming into force of this subsection shall continue in effect for the unexpired portion of its term as if it were a licence authorizing the carrying on of a broadcasting undertaking issued under this Act and may be amended, renewed, suspended or revoked in the manner provided in this Act.

G. whereas on the evening of 7 November 2007 two opposition TV channels, Imedi and Caucasia, were taken off the air; whereas the buildings of Imedi television and radio were stormed by armed members of security agencies wearing masks before the announcement of the state of emergency and without prior notification, with part of the station's broadcasting equipment destroyed; whereas a Tbilisi court suspended Imedi's broadcasting licence and froze its assets on the grounds that its coverage of the events of 7 November 2007 amounted to incitement to overthrow the government; whereas the court notification was not handed over to Imedi's director until one week later; whereas the Georgian National Communications Commission (GNCC) has suspended Imedi's TV broadcasting licence for three months, citing the station's violation of the law on broadcasting,

Condemns all attempts by the Government of Pakistan to control media freedom by introducing amendments to broadcasting licences, restricting the live broadcasting of outside events and issuing government directives to media and broadcasting associations; condemns all forms of threat, coercion and intimidation of journalists and broadcasters;

(2) The broadcasting undertaking must record the dates of the making and destruction of all reproductions and any other prescribed information about the reproduction, and keep the record current (3) The broadcasting undertaking must make the record referred to in subsection (2) available to owners of copyright in the sound recordings, performer's performances or works, or their representatives, within twenty-four hours after receiving a request (4) The broadcasting undertaking must destroy the reproduction when it no longer possesses the sound recording or performer's performance or work embodied in the sound recording, or at the latest within thirty days after making the reproduction, unless the copyright owner authorizes the reproduction to be retained (5) If the copyright owner authorizes the reproduction to be retained, the broadcasting undertaking must pay any applicable royalty (6) This section does not apply if a licence is available from a collective society to reproduce the sound recording, performer's performance or work (7) In this section, ``broadcasting undertaking'' means a broadcasting undertaking as defined in the Broadcasting Act that holds a broadcasting licence issued by the Canadian Radio- television and Telecommunications Commission under that Act'.
