(157) The Commission should adopt the draft regulatory technical standards developed by ESMA regarding exemptions that relate to activities considered to be ancillary to the main business, regarding the information to be provided and certain requirements in the context of procedures for granting and refusing requests for authorisation of investment firms, regarding acquisition of the qualifying holding, regarding algorithmic trading, regarding obligation to execute orders on terms most favourable to clients, regarding the suspension and removal of financial instruments from trading on a regulated market, on an MTF or an OTF, regarding freedom to provide investment services and activities, regarding establishment of a branch, regarding systems resilience, circuit breakers and electronic trading, regarding tick sizes, regarding synchronisation of business clocks, regarding admission of financial instruments to trading, regarding the position limits and position management controls in commodity derivatives, regarding procedures for granting and refusing requests for authorisation of data reporting services providers, regarding organisational requirements for APAs, CTPs and ARMs and regarding cooperation among competent authorities.

(106) The power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of details concerning exemptions, the specification of certain definitions, the criteria for the assessment of proposed acquisitions of an investment firm, the organisational requirements for investment firms, the management of conflicts of interest, conduct of business obligations in the provision of investment services, the execution of orders on terms most favourable to the client, the handling of client orders, the transactions with eligible counterparties, the SME growth markets, the conditions for the assessment of initial capital of third-country firms, measures concerning systems resilience, circuit breakers and electronic trading, the admission of financial instruments to trading, the suspension and removal of financial instruments from trading, the thresholds for position reporting held by categories of traders, the clarification of what constitutes a reasonable commercial basis for an APA to make information public, for CTPs to provide access to data streams and for an approved reporting mechanism (ARM) to report information, the clarification of details of the information obligation on CTP, the cooperation between competent authorities.
(106) Il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne en ce qui concerne les modalités détaillées des exemptions, la spécification de certaines définitions, les critères d'évaluation des acquisitions envisagées par une entreprise d'investissement, les exigences organisationnelles applicables aux entreprises d'investissement, la gestion des conflits d'intérêts, les règles de conduite dans le cadre de la fourniture de services d'investissement, l'exécution d'ordres aux conditions les plus favorables pour le client, le traitement des ordres des clients, les transactions avec des contreparties éligibles, les marchés de croissance des PME, les conditions d'évaluation du capital initial des entreprises de pays tiers, les mesures concernant la résilience des systèmes, les coupe-circuit et le trading électronique, l'admission des instruments financiers à la négociation, la suspension et le retrait d'instruments financiers de la négociation, les seuils applicables à la déclaration des positions par catégorie de trader, l'indication de ce que sont des conditions commerciales raisonnables pour qu'un APA publie des informations, pour que les CTP fournissent l'accès aux flux de données et pour qu'un mécanisme de déclaration agréé (ARM) déclare les informations, l'indication des modalités de l'obligation d'information sur les CTP et la coopération entre les autorités compétentes.

(106) In order to attain the objectives set out in this Directive, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of details concerning exemptions, the clarification of definitions, the criteria for the assessment of proposed acquisitions of an investment firm, the organisational requirements for investment firms, the management of conflicts of interest, conduct of business obligations in the provision of investment services, the execution of orders on terms most favourable to the client, the handling of client orders, the transactions with eligible counterparties, the SME growth markets, the conditions for the assessment of initial capital of third country firms, measures concerning systems resilience, circuit breakers and electronic trading, the admission of financial instruments to trading, the suspension and removal of financial instrtuments from trading, the thresholds for position reporting held by categories of traders, the cooperation between competent authorities.
(106) Afin d’atteindre les objectifs fixés dans la présente directive, il convient de conférer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité en ce qui concerne les modalités détaillées des exemptions, la clarification des définitions, les critères d’évaluation des acquisitions envisagées par une entreprise d’investissement, les exigences organisationnelles applicables aux entreprises d’investissement, la gestion des conflits d’intérêts, les règles de conduite dans le cadre de la fourniture de services d’investissement, l’exécution d’ordres aux conditions les plus favorables pour le client, le traitement des ordres des clients, les transactions avec des contreparties éligibles, les marchés de croissance des PME, les conditions d’évaluation du capital initial des entreprises de pays tiers, les mesures concernant la résilience des systèmes, les coupe-circuit et le trading électronique, l’admission des instruments financiers à la négociation, la suspension et le retrait d’instruments financiers de la négociation, les seuils applicables à la déclaration des positions par catégorie de trader et la coopération entre les autorités compétentes.
