In order to clarify the regime of exemptions for the European System of Central Banks (ESCB), other national bodies performing similar functions and bodies intervening in the management of public debt, it is appropriate to limit such exemptions to the bodies and institutions performing their functions in accordance with the law of one Member State or in accordance with the Union law, as well as to international bodies of which two or more Member States are members and which have the purpose of mobilising funding and providing financial assistance to the benefit of their members that are experiencing or threatened by severe financing problems, such as the European Stability Mechanism.
Afin de clarifier le régime des exemptions en ce qui concerne le système européen des banques centrales (SEBC), les autres organismes nationaux à vocation similaire et les organismes intervenant dans la gestion de la dette publique, il convient de limiter ces exemptions aux organismes et institutions qui exercent leurs fonctions conformément au droit d’un État membre ou au droit de l’Union ainsi qu’aux organismes internationaux dont font partie deux ou plusieurs États membres et qui ont pour finalité de mobiliser des fonds et d’apporter une aide financière à ceux de leurs membres qui connaissent des difficultés financières graves ou risquent d’y être exposés, par exemple le mécanisme européen de stabilité.

2. A Member State that meets one of the conditions set out in points (a), (b) and (c) of Article 77(2), may contribute a part of the overall resources distributed in accordance with Articles 19 and 20 to a risk-sharing instrument which shall be established by means of a cooperation agreement to be concluded by the Commission either with the EIB or with national or international public sector bodies or bodies governed by private law with a public service mission providing adequate guarantees as referred to in Article 54(2)(c) of Regulation (EC, Euratom) No 1605/2002, under similar terms and conditions to those applied to and by the EIB (“contracted implementing body”), to cover the provisioning and capital allocation of guarantees and loans, as well as other financial facilities, granted under the risk-sharing instrument.

Un État membre qui remplit l’une des conditions énoncées à l’article 77, paragraphe 2, points a), b) et c), peut consacrer une partie des ressources globales réparties conformément aux articles 19 et 20 à un instrument de partage des risques établi au moyen d’un accord de coopération conclu par la Commission, soit avec la BEI, soit avec des organismes de droit public national ou international ou des entités de droit privé investies d’une mission de service public présentant des garanties suffisantes conformément à l’article 54, paragraphe 2, point c), du règlement (CE, Euratom) no 1605/2002, selon des modalités analogues à celles appliquées à la BEI et par la BEI (ci-après dénommés “organisme d’exécution désigné”), aux fins de la constitution de provisions et de dotations en capital en faveur de garanties et de prêts et d’autres facilités de financement octroyés dans le cadre de l’instrument de partage des risques.
