On the basis of the above, the Commission considers that the compensatory measures described above fulfil the requirements of the RR Guidelines. In particular: (a) they benefit Varvaressos’s competitors, within the meaning of point 31; (b) they take a form provided for in points 39 and 46(c); and (c) they will take place in the market where Varvaressos will have a significant market position after restructuring, within the meaning of point 40.

Thus, the Commission considers that the benefit of Varvaressos through the 2007 and 2008 guarantees was not the total loans, which it could have received even without the State guarantees, but the lower interest rate, which it received thanks to the guarantees.
La Commission considère donc que l’avantage conféré à Varvaressos par les garanties de 2007 et 2008 n’était pas l’ensemble des prêts, qu’elle aurait pu obtenir même sans les garanties d’État, mais le taux d’intérêt plus faible qu’elle a obtenu grâce à ces garanties.
