77-78, the Supreme Court of Canada found that “insofar as the Immigration Act leaves open the possibility of deportation to torture, the Ministershould generally decline to deport refugees where on the evidence there is a substantial risk of torture”. However, the Court went on to say: “We do not exclude the possibility that in exceptional circumstances, deportation to face torture might be justified, either as a consequence of the balancing process mandated by section 7 of the Charter or under section 1”.
