(9a) The role of victims in the criminal justice system and their possibility of actively participating in criminal proceedings vary in each Member State, depending on the national system, and is determined by one of the following criteria: the national system provides for a legal status as a party to criminal proceedings; the victim is under a legal requirement or is requested to actively participate in criminal proceedings, such as witnesses; and/or the victim has a legal entitlement under national law to actively participate in criminal proceedings and is seeking to do so, where the national system does not provide for a legal status as a party to the criminal proceedings.

He emphasises that active refers not just to the ability to be physically active or to the ability to be able to participate in the labour force for longer, but active should equally refer to a person's continual and active participation in social, economic, cultural, and civic affairs.
