In recent years, certain parts of the French Post Office's business in the areas open to competition have been the subject of decisions under the competition rules: in 1991 the Commission authorized pursuant to the Merger Control Regulation the setting-up of a joint venture between the Australian courier TNT and the German, Canadian, French, Dutch and Swedish Post Offices; and in February 1995 it concluded that the French Post Office's tax arrangements did not involve state aid within the meaning of the EC Treaty.
Au cours de ces dernières années, certains aspects des activités de la Poste française dans les domaines ouverts à la concurrence avaient déjà fait l'objet d'une décision au titre des dispositions en matière de concurrence: en 1991, la Commission avait autorisé, en application du règlement sur le contrôle des concentrations, la création d'une entreprise commune entre le coursier australien TNT et les Postes allemande, canadienne, française, néerlandaise et suédoise; au mois de février 1995, la Commission avait conclu que le régime fiscal de la Poste française ne comportait pas d'aides d'Etat aux termes du traité CE.
