Prior to the establishment of the EU common visa policy, the European Union and its Member States have concluded international agreements, like association agreements, with third countries dealing i.a. with the movement of persons and services, which might have an impact on the visa requirement imposed on nationals of third countries.

Calls on the Member States to implement rules establishing paid maternity/paternity leave following the birth of a child and to promote the use of the right to parental leave shared equitably between women and men; urges the Member States, to this end, to combat the economic, social and cultural prejudices associated with the right of parental leave for men; calls on the Commission to revise Council Directive 96/34/EC of 3 June 1996 on the framework agreement on parental leave concluded by UNICE, CEEP and the ETUC [6]; considers that parental leave, with a simultaneous guarantee of job retention, should be taken up by both fathers and mothers; advocates a system of incentives which will encourage partners to share parental leave, and recompense for the costs associated with bringing up children; calls on the Commission to consult both sides of industry on possible changes to the reforms concerning parental leave which were introduced in 1996, the purpose of which might be to extend the minimum period of three months to six;

It is therefore necessary for the Commission to require the undertakings to which this Decision is addressed to bring the infringement to an end (if they have not already done so) and henceforth to refrain from any agreement, concerted practice or decision of an association which might have the same or similar object or effect.

(9) Given the similarity between sale and exclusive licensing, and the danger that the requirements of this Regulation might be evaded by presenting as assignments what are in fact exclusive licenses restrictive of competition, this Regulation should apply to agreements concerning the assignment and acquisition of patents or know-how where the risk associated with exploitation remains with the assignor.
(9) Eu égard aux ressemblances existant entre la vente et la licence exclusive, et afin d'empêcher le contournement du règlement en faisant passer pour des cessions des licences exclusives restrictives de concurrence, le présent règlement doit s'appliquer également aux accords de cession et d'acquisition de brevets ou de savoir-faire dans la mesure où le cédant continue d'assumer le risque de leur exploitation économique.

The 'parties concerned' referred to in Article 1 (2) of Protocol 3 to the Surveillance and Court Agreement are not only the enterprise or enterprises receiving aid but also the persons, enterprises or associations whose interests might be affected by the grant of the aid, in particular competing enterprises and trade associations (13).
