5. Welcomes Kosovo’s first ever country-wide local elections held under Kosovan law on 3 November, 17 November and 1 December 2013 as having marked a huge step forward for democracy in Kosovo and for citizens’ confidence in the democratic processes underpinning the normalisation process, and welcomes the overall orderly conduct of the elections, as assessed in the preliminary statements of the EU Election Observation Mission (EOM); welcomes the fact that Kosovo’s first woman mayor was elected; continues to stress the need to encourage women candidates to participate in future elections; welcomes the measures taken by Kosovan authorities to enhance trust in the country’s institutions, for example the strong stand-by mechanism by which citizens can complain about intimidation and irregularities on election day; welcomes the visible voter turnout in Serbian-dominated municipalities to the south of the Ibar river as a crucial step towards the formation of the Association of Serbian Municipalities; stresses, in this regard, that the failure to inaugurate a new mayor in North Mitrovica and the subsequent call for new elections in this municipality must not hinder the continuation of the process and the full implementation of the 19 April 2013 agreement; strongly condemns the murder of Dimitrije Janicijevic, municipal councillor of North Mitrovica, and calls for the relevant authorities to start immediately the investigation and bring the perpetrators to justice;

My view, which is shared by a majority in Central America, is that an Association Agreement dominated by neo-liberal formulae would be a mistake and would only lead to inequalities and poverty in Central America, benefiting the multinationals.

In order to ensure that trade between Member States is not affected or competition within the internal market distorted, it is necessary to prohibit in principle for the three modes of transport specified above all agreements between undertakings, decisions of associations of undertakings and concerted practices between undertakings and all instances of abuse of a dominant position within the internal market which could have such effects.

(23) For the purposes of this Regulation, the concept of unfair trade practices covers prohibitions on agreements between undertakings, decisions by associations of undertakings and concerted practices which may affect trade between Member States and which have as their object or effect the prevention, restriction or distortion of competition within a Member State or within the internal market, as well as prohibitions on the abuse of a dominant position within a Member State or within the internal market, within the meaning of Articles 81 and 82 of the Treaty .

For the purposes of this Regulation, the concept of restriction of competition should cover prohibitions on agreements between undertakings, decisions by associations of undertakings and concerted practices which have as their object or effect the prevention, restriction or distortion of competition within a Member State or within the internal market, as well as prohibitions on the abuse of a dominant position within a Member State or within the internal market, where such agreements, decisions, concerted practices or abuses are prohibited by Articles 81 and 82 of the Treaty or by the law of a Member State.

The Stabilisation and Association Agreement / Interim Agreement on trade and trade-related matters provides for a competition regime to be applied in trade relations between the Community and Croatia based on the criteria of Articles 81 and 82 of the EC Treaty (agreements between undertakings, abuses of dominant position), Article 86 (public undertakings and undertakings with special or exclusive rights) and of Article 87 (State aid).
