The European Commission has asked the Czech Republic to bring its legislation in line with EU telecoms rules. The Commission has concerns that, contrary to the EU Authorisation Directive, the Czech legal system requires telecoms operators to apply for registration in the Commercial Register as well as to establish a seat in the Czech Republic in order to provide electronic communications services. This makes it more difficult for a foreign operator to provide telecoms services in the country. The Commission also has concerns that notification requirement applicable to telecoms operators go beyond what can be imposed in view of the maximum harmonisation provided by EU law in this regard. For instance, telecoms operators need to provide evidence that they fulfil Czech tax and healthcare obligations for doing business. This creates red tape, is an obstacle to cross-border services and goes beyond the purpose of identifying the provider as required by the Authorisation Directive.The Commission's request takes the form of a reasoned opinion.
La Commission européenne a envoyé un avis motivé à la République tchèque lui demandant de mettre sa législation en conformité avec les règles de l'UE en matière de télécommunications. La Commission s'inquiète de ce que, contrairement aux dispositions de la directive Autorisation de l'UE, la législation tchèque exige des opérateurs de télécommunications qu'ils fassent une demande d'inscription au registre du commerce et qu'ils établissent un siège en République tchèque pour pouvoir fournir des services de communications électroniques. Ainsi, un opérateur étranger rencontre plus de difficultés pour offrir des services de télécommunications dans le pays. La Commission craint également que l’obligation de notification applicable aux opérateurs de télécommunications aille au-delà de ce qui peut être exigé compte tenu de l’harmonisation maximale prévue par le droit de l’Union à cet égard.

Although the Commission sent a letter of formal notice and a reasoned opinion asking Czech Republic and Luxembourg to notify full compliance with the Directive, Luxembourg has notified measures only partially transposing Directive 2014/54/EU into national law and Czech Republic has not yet communicated transposition of the Directive at all.Therefore, on the basis of the procedure set out in Article 260(3) TFEU, the Commission will request the Court of Justice to impose a daily penalty payment of €6,528 on Luxembourg and €33,510.4 on the Czech Republic until the Directive is fully transposed into national legislation.
