A. while on the one hand, the existing primary law of the European Community does not confer on the Community any responsibility for sport in general or for professional football in particular, on the other hand neither are they excluded from the scope of application and, among other things, the case-law of the European Court of Justice (Court of Justice) and decisions taken by the European Commission make clear that in particular the ban on discrimination imposed by Article 12 of the EC Treaty, the principle of freedom of movement for workers enshrined in Article 39 thereof, the freedom of establishment and the freedom to provide services laid down in Articles 43 and 49 thereof, the provisions on competition set out in Articles 81 to 87 thereof and the provisions on employment and social policy have had an impact on sport and professional football,
A. considère, d'une part, que le droit primaire en vigueur au sein de la Communauté européenne ne confie à cette dernière aucune compétence ni en matière de sport en général ni en matière de football professionnel en particulier, mais que les domaines en question ne doivent pas non plus être exclus de son champ d'application, et fait, entre autres, observer que la jurisprudence de la Cour de justice des Communautés européennes (Cour de justice) et la pratique décisionnelle de la Commission montrent que l'interdiction de discrimination établie par l'article 12 du traité CE, la libre circulation des travailleurs au sens de l'article 39 du traité, la liberté d'établissement et la libre prestation des services visées aux articles 43 et 49 du traité, les règles de concurrence précisées aux articles 81 à 87 du traité ainsi que les dispositions applicables à la politique sociale et de l'emploi ont notamment un impact sur le sport et le football professionnel,
