3. Member States may not maintain or introduce, in their national law, provisions diverging from those laid down in Article 2, Article 9(1) to (4) and Article 9(8), Articles 10 and 11, Article 12(1) to (3), Article 13(1), Articles 14 to 19, Articles 30 to 33 and Article 36 including more stringent provisions to ensure a different level of consumer protection.
3. ‘credit institution’ means either: (a) a credit institution within the meaning of Article 2 and Article 4(1)(a) of Directive 2006/48/EC of the European Parliament and of the Council of 14 June 2006 relating to the taking up and pursuit of the business of credit institutions (8), as implemented in national law, that is subject to supervision by a competent authority; or (b) another credit institution within the meaning of Article 123(2) of the Treaty on the Functioning of the European Union that is subject to scrutiny of a standard comparable to supervision by a competent authority;

Where a national regulatory authority determines that a relevant market is not effectively competitive, it shall identify undertakings which individually or jointly have a significant market power on that market in accordance with Article 14 and the national regulatory authority shall on such undertakings impose appropriate specific regulatory obligations referred to in paragraph 2 of this Article or maintain or amend such obligations where they already exist.

until 14 May 2014 for any information submitted for the purposes of this Directive, except in the case where data are already protected according to existing national rules relating to biocidal products, in which case such data shall be protected in that Member State until the expiry of any remaining period of data protection provided for under those national rules, but not beyond 14 May 2014 or, if applicable, not beyond the date to which the transitional period referred to in Article 16(1) is extended in accordance with Article 16(2); ’;

Article 14(2) of the Directive provides that, where the laws of a Member State prescribe that the nationals of another Member State who reside there have the right to vote for the national parliament of that State under exactly the same conditions as national voters, the first Member State may, by way of derogation from the Directive, refrain from applying Articles 6 to 13 in respect of such nationals.

In addition to the consultation referred to in paragraph 1, where a national regulatory authority intends to take measures which have a significant impact on the market under Article 14(3) or Article 15(3), (4) and (5) of this Directive or Article 8(3) of Directive 2001/./EC (Access Directive), it shall at the same time make the draft measure accessible to the Commission and the national regulatory authorities in other Member States, together with the reasoning on which the measure is based, in accordance with Article 5(3) of this Directive, and inform the Commission and other national regulatory authorities thereof.
