The delegated acts adopted pursuant to Article 6(3), Article 11(2), Article 13(6), Article 17(2), Article 18(4), Article 20(3), Article 23(3), Article 26(2) and Article 29(4) shall enter into force only if no objection has been expressed by either the European Parliament or the Council within a period of two months of notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they do not intend to raise any objections.

Nevertheless, it is recalled that all exporting producers have the possibility to request an ‘interim review’ to have their situation revised pursuant to Article 11(3) of the basic Regulation or, those exporting producers who have not exported the product concerned during the period of investigation on which the measures were based, have the possibility to request a ‘new exporter review’ pursuant to Article 11(4) of the same Regulation.

Underlines that there is significant legal uncertainty in the manner in which some key provisions of ACTA have been drafted (e.g. Article 11 (Information related to Infringements), Article 23 (criminal offences), Article 27 (scope of the enforcement measures in the digital environment), especially Article 27(3) (cooperation mechanisms), and Article 27(4); warns against the potential to deliver fragmented approaches within the Union with risks of inadequate compliance with fundamental rights, particularly the right to protection of personal data, the right to due process and the right to conduct business; points out that these risks are especially present as regards Article 27 (3) and (4) in light of the lack of precision of those texts but also having in mind the practices currently taking place in some Member States (e.g. large scale monitoring of Internet by private parties) whose conformity with the Charter is questionable;

In order to meet the exceptional circumstances of the transition to the decommitment rules introduced by this Regulation, appropriations which have been cancelled because of decommitments made by the Commission for the financial year 2007 in the implementation of the first subparagraph of Article 93(1) and of Article 97 of Regulation (EC) No 1083/2006, pursuant to Article 11 of the Financial Regulation, shall be reconstituted to the extent necessary for the implementation of the second subparagraph of Article 93(1) of Regulation (EC) No 1083/2006.

Products referred to in Article 10 originating in countries which have been notified of a decision granting them entitlement to the special incentive arrangements shall be admitted under the arrangements provided for in Article 10 from the date of entry into force of that decision on presentation of a statement by the beneficiary country's competent authorities, duly identified during appraisal of the request, certifying that the products in question and their components have been manufactured in that country, or in a country entitled to regional cumulation within the meaning of Article 72 of Regulation (EEC) No 2454/93, under conditions complying with the domestic legislation referred to in the first indent of Article 11(1) and are therefore eligible for the special incentive arrangements.
