As for the practical use to which the European Arrest Warrant is put, I would like to state, very briefly in view of the time available, that long-term support for its implementation is available in the shape of information, readily accessible on the Internet, and provided not only by the Council Secretariat, but also by the European Judicial Network, and that the judicial atlas is also rendering outstanding service in this, so that the direct contact between the judicial authorities, which is so urgently necessary to the best possible application of the European Arrest Warrant has thereby been made considerably easier.

If two or more States have issued a European arrest warrant or an arrest warrant for the same person, the decision as to which of the arrest warrants shall be executed shall be taken by the executing judicial authority with due consideration of all the circumstances and especially the relative seriousness and place of the offences, the respective dates of the arrest warrants and whether the warrant has been issued for the purposes of prosecution or for execution of a custodial sentence or detention order.

The supranational European Prosecutor proposed by the Commission, meanwhile, would lead us into an administrative black hole, since not only would we have to harmonise charges, penalties, restrictions and all kinds of procedures, such as acceptability of evidence, but we would also have to consider the issue of protecting individual freedom for all coercive acts required by the European Prosecutor: searches, seizures, telephone tapping, arrest warrants, judicial reviews and pre-trial detention, not to mention, of course, the vast issue of the democratic control that would need to be established.

This situation is also covered by Article 4(3) of the Framework Decision: the enforcing judicial authority can refuse to enforce a European arrest warrant if the judicial authorities in the Member State of enforcement have decided to refrain from prosecuting the offence on which the European arrest warrant is based or to drop its prosecution.

1. where the European arrest warrant has been issued for the purposes of executing a sentence or a detention order imposed by a decision rendered in absentia and if the person concerned has not been summoned in person or otherwise informed of the date and place of the hearing which led to the decision rendered in absentia, surrender may be subject to the condition that the issuing judicial authority gives an assurance deemed adequate to guarantee the person who is the subject of the European arrest warrant that he or she will have an opportunity to apply for a retrial of the case in the issuing Member State and to be present at the judgment;

The executing judicial authority may refuse to execute a European arrest warrant if the requested person is the subject of legal proceedings in the executing Member State in respect of the offences for which the warrant has been issued, unless the executing judicial authority decides to waive jurisdiction in favour of the State that issued the European arrest warrant.
