Moreover, all the parties should agree in the research and development agreement that they will all have full access to the final results of the joint research and development, including any arising intellectual property rights and know-how, for the purposes of further research and development and exploitation, as soon as the final results become available.

(h) the formulation of provisions governing the intellectual property rights arising from the activities carried out under the EMRP and the implementation and coordination of the research and development programmes and activities undertaken at national level by the participating States in such a way that they aim at promoting the creation of such knowledge and at supporting a wide use and dissemination of the knowledge created. The approach taken shall follow the model established by Regulation (EC) No 1906/2006 of the European Parliament and of the Council of 18 December 2006 laying down the rules for the participation of undertakings, research centres and universities in actions under the Seventh Framework Programme and for the dissemination of research results (2007-2013) (║ "the Rules for Participation in the Seventh Framework Programme").

2. Each Party shall ensure that its treatment of the intellectual property rights and obligations of participants in indirect cooperative activities, and the related rights and obligations arising from such participation, shall be consistent with the relevant laws and regulations and international conventions, including the Agreement on trade-related aspects of intellectual property rights, Annex 1C of the Marrakech Agreement establishing the World Trade Organisation as well as the Paris Act of 24 July 1971 of the Berne Convention for the protection of literary and artistic works and the Stockholm Act of 14 July 1967 of the Paris Convention for the protection of industrial property.
2. Chaque partie veille à ce que le traitement des droits et des obligations en matière de propriété intellectuelle des participants aux activités de coopération indirectes, et des droits et des obligations connexes résultant de cette participation, soit compatible avec les lois et règlements et les conventions internationales applicables, y compris l’accord sur les aspects des droits de propriété intellectuelle qui touchent au commerce, l’annexe 1C de l’accord de Marrakech instituant l’Organisation mondiale du commerce, l’acte de Paris du 24 juillet 1971 de la convention de Berne pour la protection des œuvres littéraires et artistiques, ainsi que l’acte de Stockholm du 14 juillet 1967 de la convention de Paris pour la protection de la propriété industrielle.

In the event either Party concludes that a new type of intellectual property not covered in a TMP or agreement between designated implementing agencies may result from a cooperative activity undertaken pursuant to this Agreement, or if other unforeseen difficulties arise, the Parties shall enter into immediate discussions in order to assure that the protection, exploitation and dissemination of the intellectual property in question are adequately provided for in their respective territories, in accordance with their national legislation.

The Parties shall ensure that they and/or their participants notify one another within a reasonable time of the creation of any intellectual property arising under the Agreement or implementation arrangements and to seek protection for such intellectual property in a timely fashion;
