It is now a question of revising this regulation to modernise its provisions and to ‘improve’ certain procedures: communication between judges, the issue of authentic acts, the issue of arbitration and, most particularly, the issue of the exequatur. Without going into detail about these complex legal issues, I keenly await the amendment of this regulation, an amendment which will provide European citizens with better legal protection: better ‘free movement’ of judgments and legal decisions, greater ‘mutual confidence’ between the jurisdictions and legal systems of the various Member States, namely a strengthening of legal certainty in Europe and of the rights of European citizens.
Il s’agit aujourd’hui de réviser ce règlement pour moderniser ses dispositions et «améliorer» certaines procédures: la communication entre les juges, la question des actes authentiques, la question de l’arbitrage et surtout la question de l’exequatur.Sans entrer dans le détail de ces questions juridiques complexes, j’attends vivement la révision de ce règlement, révision qui permettra une meilleure protection juridique des citoyens européens: une meilleure «libre circulation» des jugements et décisions judiciaires, davantage de «confiance mutuelle» entre les juridictions et systèmes judiciaires des différents États membres, soit un renforcement de la sécurité juridique en Europe et des droits des citoyens.

In the context of the need to amend regulations, and in light of the WTO’s ruling in arbitration, this report improves these instruments, which have made a significant contribution to market access at higher prices, and have served to create jobs in rural areas of Europe.

(b) the Association Committee shall, no later than six months after the entry into force of this Agreement, establish a list of at least five individuals who are not nationals of either Party, and who are willing and able to serve as arbitrators and be identified as chairperson of arbitration panels in financial services. The Association Committee shall ensure that the list always contains five individuals at any point in time. Those individuals shall have expertise or experience in financial services law or practice, which may include the regulation of financial institutions, be independent, serve in their individual capacities and not be affiliated with, nor take instructions from, any Party or organisation and shall comply with the Code of Conduct set out in Annex XVI. Such list may be amended every three years;
