Is not in favour of the removal of certain conditions imposed by the current MVBER for an agreement to be exempted, namely the contractual clauses on multi-branding, notice of termination, duration, arbitration of disputes, litigation and business transfers within the network; recalls, in particular, that the need to simplify the conditions for business transfers is part of the first principle of the Small Business Act; draws attention to the risk represented by a single branding obligation for consumer choice and dealers' independence vis-à-vis manufacturers; fears that these clauses might become subject to the different national contract laws;

if liability arising out of any marine casualty is finally and definitely imposed on the administration by a court of law or as part of the settlement of a dispute through arbitration procedures, together with a requirement to compensate the injured parties for personal injury not resulting in death, which is proved in that court of law to have been caused by any negligent or reckless act or omission of the recognised organisation, its employees, agents or others who act on behalf of the recognised organisation, the administration shall be entitled to claim financial compensation from the recognised organisation to the extent that that personal injury not resulting in death was, as decided by that court, caused by the recognised organisation; the Member States may limit the maximum amount payable by the recognised organisation, which must, however, be at least equal to EUR 4 million, except where the amount determined in the judgment or settlement is lower, in which case this latter amount shall constitute the compensation payable ;

Consequently, enterprises can currently only avail of the dispute settlement provisions of double taxation conventions which do not impose any binding obligation to eliminate double taxation, unlike the Arbitration Convention.

(ii) if liability arising out of any incident is finally and definitely imposed on the administration by a court of law or as part of the settlement of a dispute through arbitration procedures, together with a requirement to compensate the injured parties for personal injury or death, which is proved in that court of law to have been caused by any negligent or reckless act or omission of the recognised organisation, its employees, agents or others who act on behalf of the recognised organisation, the administration shall be entitled to financial compensation from the recognised organisation to the extent that the said personal injury or death is, as decided by that court, caused by the recognised organisation; the Member States may limit the maximum amount payable by the recognised organisation, which must, however, be at least equal to EUR 4 million;

i) si l'administration est finalement déclarée responsable d'un incident de manière définitive par une cour ou un tribunal ou à la suite du règlement d'un litige par la voie d'une procédure d'arbitrage et doit indemniser les personnes lésées dans le cas d'un préjudice ou d'un dommage matériel, d'un dommage corporel ou d'un décès dont il est prouvé, devant cette juridiction, qu'il résulte d'un acte ou d'une omission volontaire ou d'une négligence grave de l'organisme agréé, de ses services, de son personnel, de ses agents ou autres agissant au nom de l'organisme agréé, elle peut faire valoir son droit à indemnisation par l'organisme agréé pour autant que ledit préjudice, dommage matériel, dommage corporel ou décès est dû, selon la décision de cette juridiction, à l'organisme agréé;

(q) excluding or hindering the consumer's right to take legal action or exercise any other legal remedy, particularly by requiring the consumer to take disputes exclusively to arbitration not covered by legal provisions, unduly restricting the evidence available to him or imposing on him a burden of proof which, according to the applicable law, should lie with another party to the contract.
q) de supprimer ou d'entraver l'exercice d'actions en justice ou des voies de recours par le consommateur, notamment en obligeant le consommateur à saisir exclusivement une juridiction d'arbitrage non couverte par des dispositions légales, en limitant indûment les moyens de preuves à la disposition du consommateur ou en imposant à celui-ci une charge de preuve qui, en vertu du droit applicable, devrait revenir normalement à une autre partie au contrat.
