This infringement relates to: (a) the impact of several projects and activities on the Natura 2000 GR2550005 ‘Thines Kyparissias’ site (proposed Site of Community Importance, SCI, from 1 April 1997, and Site of Community Importance, SCI, from 1 September 2006) and, more particularly, on the priority species Caretta caretta and the sand dune habitats, including the priority habitat 2250* Coastal dunes with Juniperus spp and (b) failure to take the necessary measures to establish and implement an effective system of strict protection of the sea turtle Caretta caretta, in the site in question, in order to avoid both any disturbance of that species during its breeding period and any activity which can cause deterioration or destruction of its breeding sites.

Provisions are required concerning liability for damage to the local environment and the climate, resulting from any failure of permanent containment of CO. Liability for environmental damage (damage to protected species and natural habitats, water and land) is regulated by Directive 2004/35/EC of the European Parliament and of the Council of 21 April 2004 on environmental liability with regard to the prevention and remedying of environmental damage , which should be applied to the operation of storage sites pursuant to this Directive.

Since the objective of this Directive, namely to establish a common framework for the prevention and remedying of environmental damage at a reasonable cost to society, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level by reason of the scale of this Directive and its implications in respect of other Community legislation, namely Council Directive 79/409/EEC of 2 April 1979 on the conservation of wild birds , Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora , and Directive 2000/60/EC of the European Parliament and of the Council of 23 October 2000 establishing a framework for Community action in the field of water policy , the Community may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

(6) The objectives of Annex V supplement the objectives of Council Directive 79/409/EEC of 2 April 1979 on the conservation of wild birds(4) and of Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora(5); those Directives already provide a Community framework for the protection of habitats and species in the geographical area in which they apply; the adoption of the Annex V by the Community does not prejudice the implementation of those Directives.
