As noted above, the Court held in Kyrian that‘the first stage’ of enforcement in the context of mutual assistance is, notification to the addressee by the requested authority of all instruments and decisions which emanate from the Member State in which the applicant authority is situated and which relate to a claim and/or its recovery, the notification having to be carried out on the basis of information supplied by the applicant authority As will be illustrated below, the same must necessarily apply when a Member States attempts to notify a claim without the assistance of a requested authority, as is the case in the main proceedings.

Also by creating a uniform set of regulations, directly applicable throughout the European Union, thereby guaranteeing that each and every request for asylum is actually examined, and at the same time preventing multiple applications being made in a number of States.

As Mrs Sbarbati points out in her report for the Committee on Petitions, we have attempted to find a balance, which is fairly difficult, I admit, between, firstly, the legitimate interests of the Member States in combating the phenomenon of ‘asylum shopping’ and the same individual submitting multiple applications in order to remain on European Union territory for as long as possible and, secondly, the interests of asylum applicants to have their application examined within reasonable time limits and so that they are not kept apart from their family members for lengthy periods, when there is no real reason why their application should not be examined in the same Member State.
Comme l'a bien noté Mme Sbarbati dans son rapport pour la commission des pétitions, nous avons tenté de trouver un équilibre, assez difficile, je le reconnais, entre d'une part, l'intérêt légitime des États membres à lutter contre le phénomène de l'asylum shopping et des demandes multiples présentées par un même individu pour se maintenir plus longtemps sur le territoire de l'Union européenne et, d'autre part, l'intérêt des demandeurs d'asile à voir leur demande examinée dans des délais raisonnables et à ne pas être durablement séparés des membres de leur famille, lorsqu'aucun motif raisonnable ne s'oppose à ce que leur demande soit examinée dans le même État membre.
