Commissioner Hübner failed to indicate in reply to my question No. E-1269/07 how it is that the Elanet company (in which she herself admits that the Greek Federation of Industry - SEV - has a vested interest) is involved in the approval of 299 of the 300(!) applications submitted to the Finance Ministry, as pointed out by the Greek press (for example ‘Ethnos’ of 13 December 2006). I am, therefore, compelled, as I also mentioned in my above question, to raise the matter before the European Parliament in plenary in the hope of obtaining a full reply from (the otherwise likeable) Mrs Hübner.
Dans la réponse par elle réservée à la question E-1269/07 de l’auteur de la présente question, M Hübner, membre de la Commission des Communautés européennes, ne dit pas, hélas, comment il est possible que la société ELANET (à laquelle, de l’aveu même de M Hübner, la Fédération des industries grecques, ou SEB, est partie prenante), soit impliquée dans l’adoption de 299 des 300 (!) dossiers qui avaient été soumis au ministère de l’Économie, ce dont la presse grecque s’était faite l’écho (voir Ethnos du 13 décembre 2006, par exemple).

I must therefore repeat my questions in the hope of obtaining a full and convincing reply from the (likeable) Mrs Hübner so that I will not be obliged to raise the matter before the European Parliament in plenary. Under Community law and the rules governing the implementation of the third CSF and other Community initiatives, is it acceptable for applications to be approved by the representatives of the applicants?
Je me vois dès lors obligé de reposer mes questions, en espérant recevoir une réponse complète et convaincante de Mme Hübner (qui a toute ma sympathie), afin que je n'aie pas à porter la question devant l'assemblée plénière du Parlement européen: le fait que les représentants des entreprises concernées approuvent les propositions est-il compatible avec la législation de l'UE et les règles qui régissent la mise en œuvre du 3e CCA et des autres initiatives communautaires?

(3) The general system Directives permit the host Member State to require, subject to certain conditions, the applicant to take compensation steps, notably where substantial differences exist between the theoretical and/or practical education and training undergone and that covered by the qualification required in the host Member State; under Articles 39 and 43 of the Treaty, as interpreted by the Court of Justice of the European Communities(6), the host Member State must assess whether professional experience is sufficient in order to prove possession of the knowledge which is lacking; in the interests of clarity and legal certainty for individuals wishing to practise their profession in another Member State, it is desirable to incorporate into the general system Directives the requirement that the host Member State has to examine whether the professional experience gained by the applicant since obtaining his qualification(s) covers the subjects referred to above.
(3) Les directives relatives au système général permettent à l'État membre d'accueil d'exiger, sous certaines conditions, des mesures de compensation de la part du demandeur, notamment lorsque la formation qu'il a reçue porte sur des matières théoriques et/ou pratiques substantiellement différentes de celles couvertes par le diplôme requis dans l'État membre d'accueil. En vertu des articles 39 et 43 du traité, tels qu'ils ont été interprétés par la Cour de justice des Communautés européennes(6), il incombe à l'État membre d'accueil de juger si une expérience professionnelle peut valoir aux fins d'établir la possession des connaissances manquantes. Pour des raisons de clarté et de sécurité juridique à l'égard des citoyens désireux d'exercer leur profession dans un autre État membre, il est souhaitable d'intégrer dans les directives relatives au système général l'obligation qu'a l'État membre d'accueil d'examiner si l'expérience professionnelle acquise par le demandeur après l'obtention du ou des titres dont il fait état couvre les matières susmentionnées.
