IN-CONTEXT TRANSLATIONS

When an application for a grant is submitted by an applicant which does not have legal personality, in accordance with Article 131(2) of the Financial Regulation, the representatives of that applicant shall prove that they have the capacity to undertake legal obligations on behalf of the applicant and that the applicant has financial and operational capacity equivalent to that of legal persons.

16. In order to, where necessary, reinforce the deterrent effect of the exclusion and/or financial penalty, the Commission shall, subject to a decision of the contracting authority, publish on its internet site the following information related to the exclusionand, where applicable, the financial penalty in the cases referred to in points (c), (d), (e) and (f) of paragraph 1 of this Article:

Is concerned that due to the application of the 'financial discipline' mechanism, farmers with payments above EUR 2 000 will suffer a cut in direct payments paid out in the 2015 financial year; regrets the presumed effect of the application of "financial discipline" mechanism which may not lead to more efficient and accountable spendings;

The Commission shall ensure that the applicants for financial assistance under this Decision and beneficiaries of such assistance provide it with information about financial assistance received from other sources, including the general budget of the Union, and about on-going applications for such assistance.
La Commission veille à ce que les candidats à une aide financière au titre de la présente décision et les bénéficiaires d'une telle aide lui fournissent les informations sur l'aide financière qu'ils perçoivent d'autres sources, y compris du budget général de l'Union, et sur les demandes en cours d'une telle aide.

(39a) The financial instruments to be implemented under this Regulation should reflect the rules laid down in Title VIII of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union and the Delegated Act and in line with best practice rules applicable to financial instruments.
(39 bis) Les instruments financiers à mettre en œuvre au titre du présent règlement devraient concorder avec les règles établies au titre VIII du règlement (UE, Euratom) n° 966/2012 du Parlement européen et du Conseil du 25 octobre 2012 relatif aux règles financières applicables au budget général de l'Union et dans l'acte délégué, et être conformes aux règles sur les meilleures pratiques applicables aux instruments financiers.

The Commission shall ensure that the applicants for financial assistance under the Instrument and beneficiaries of such assistance provide it with information about financial assistance received from other sources, including the general budget of the European Union, and about ongoing applications for receiving such assistance.
La Commission veille à ce que les candidats à une aide financière au titre de l'instrument et les bénéficiaires d'une telle aide lui fournissent les informations sur l'aide financière qu'ils perçoivent d'autres sources, y compris du budget général de l'Union européenne, et sur les demandes en cours visant à bénéficier d'une telle aide.

This instrument will implement the principle of mutual recognition through the application of cross-border financial penalties, thereby ensuring that there will be no safe havens in the Union for those who attempt to escape the application of financial penalties set by the competent authorities of the Member States.
Cet instrument applique le principe de la reconnaissance mutuelle dans l’application transfrontalière de sanctions pécuniaires, en assurant ainsi qu’il n’existe pas de paradis au sein de l’Union pour ceux qui tentent de se soustraire à l’application de sanctions pécuniaires déterminées par les autorités compétentes des États membres.
