IN-CONTEXT TRANSLATIONS

In order to effectively tackle certain particularly serious criminal offences, such as offences specified in Directive (EU) 2017/541 and Directive 2011/93/EU, which might come to the attention of hosting service providers when carrying out their activities, Member States should be encouraged to make use of the possibility set out in Article 15(2) of Directive 2000/31/EC to establish in law reporting obligations, in compliance with the applicable law, in particular Regulation (EU) 2016/679.
Afin de lutter efficacement contre certaines infractions pénales particulièrement graves, telles que les infractions visées dans les directives (UE) 2017/541 et 2011/93/UE, qui pourraient être portées à la connaissance des prestataires de services d'hébergement dans l'exercice de leurs activités, les États membres devraient être encouragés à faire usage de la possibilité prévue à l'article 15, paragraphe 2, de la directive 2000/31/CE d'instaurer en droit des obligations d'information, dans le respect de la législation applicable, notamment le règlement (UE) 2016/679.

Should such clarification not be sufficient to ensure its practical application, it might in due course be necessary to propose an amendment creating a different connection factor in order to determine the applicable law.

Where the Commission decides that in light of the conclusions of verifications carried out pursuant to paragraph 1, there are sufficient grounds to consider that the facts established might constitute a case of non-compliance with applicable laws, regulations or international conservation and management measures, it shall, without delay:
