The appellants further submit that the General Court may not clarify in the judgment (and therefore ex post facto) the reasoning applied in the Commission's decision.

According to the appellant, the further decision was in fact a response to the written pleadings which the appellant had submitted in its initial action before the General Court, and the appellant was given no opportunity to be heard within a further prior administrative procedure.

The Appellant further submits that the Court of Appeal also failed to address the issue of whether or not the “harm principle” applies to growers and dealers of cannabis (such as the Appellant and others within the " Harm Reduction Club" ) who (by following a strategy of organics, quality control, consumer education and creating a “safe-point-of-sale”) are harmless, and who play an essential role in cannabis harm reduction;

L’appelant allègue en outre que la Cour d’appel ne s‘est pas penchée sur la question de savoir si le « principe du préjudice » s’applique ou non aux producteurs et aux distributeurs de cannabis (comme l’appelant et d’autres au sein du « Harm Reduction Club ») qui, grâce à des méthodes de culture biologique, à des contrôles de qualité, à l’éducation des consommateurs et à l’exploitation de « points de vente sûrs », sont inoffensifs et jouent un rôle essentiel dans la réduction des préjudices associés au cannabis.
