The Board of Appeal of OHIM made the same error in law as the General Court by finding, at paragraphs 34 and 37 and paragraphs 31 and 34 of the decisions of 30 October and 20 November 2007 respectively, that ‘the formal appearance [did] not fulfil the function of the mark but the label does’, and by not examining therefore whether the marks for which registration was sought varied so significantly from the norm or customs of the sector that they had distinctive character.
