IN-CONTEXT TRANSLATIONS
On the one hand, with gradual market-opening, incumbent railway companies will be obliged to become more competitive in order to withstand competition from new entrants.

If this would not be enough to resolve confidentiality issues, railway undertaking's market shares, except that of the principal or incumbent railway undertaking, can be further bundled.

Antitrust: Commission investigates practices of Czech railway incumbent České dráhy in passenger transport // Brussels, 10 November 2016

The European Commission has opened an investigation to assess whether the Czech railway incumbent České dráhy, a.s (ČD) charged prices below costs with the aim of shutting out competition in rail passenger transport services, in breach of EU antitrust rules.

In at least 8 Member States, ownership of rolling stock continues to be dominated by incumbent railway undertakings, which are unable or unwilling to make it available on attractive commercial terms to new market entrants.

Experience in Member States which have introduced market opening for domestic passenger services shows that competition in rail transport led to important efficiency gains, in particular in incumbent railway undertakings.

Underinvestment at national level is partly due to the absence of a clear "financial architecture" (investment plans, long term strategies, transparent and state-aid compatible relations between the state – nearly always the infrastructure owner and often the owner of the incumbent railway company – and infrastructure managers and railway undertakings).

In several Member States the office of the rail regulator belongs to the ministry of transport, which also owns or controls the incumbent railway undertaking – a clear case of conflict of interest.
