4. This Directive and the implementing measures adopted pursuant to it shall be without prejudice to Community waste management legislation and Community chemicals legislation, including Community legislation on fluorinated greenhouse gases.

The Commission shall ensure that total annual allocations from the EAFRD originating from the EAGGF Guidance Section for any Member State pursuant to this Regulation, and from the ERDF, the ESF and the CF, according to the Community legislation laying down general provisions governing these Funds for the period from 1 January 2007 to 31 December 2013, including the contribution of ERDF according to the Community legislation governing the European Neighbourhood Instrument, from the Instrument for Pre-Accession, according to the Community legislation governing that instrument, and from the part of the FIFG contributing to the Convergence Objective, shall not exceed 4 % of that Member State’s GDP as estimated at the time of the adoption of the Interinstitutional Agreement on budgetary discipline and improvement of the budgetary procedure.

REVIEW OF COMMUNITY ENERGY LEGISLATION As part of the ongoing exercise to simplify Community energy legislation, the Council held an exchange of views on: (a) the proposal for a Council Regulation on notifying the Commission of investment projects of interest to the Community in the petroleum, natural gas and electricity sectors (recasting of Regulations No 1056/72 and No 1215/76); (b) the Commission report on a review of Community energy legislation, and communication from the Commission concerning the repeal of several Community legislative texts (three regulations and five recommendations) in the field of energy policy.
EXAMEN DU DROIT COMMUNAUTAIRE DANS LE DOMAINE DE L'ENERGIE Le Conseil a procédé à un échange de vues, dans le cadre de l'exercice en cours de simplification du droit communautaire dans le domaine de l'énergie, sur a) la proposition de règlement concernant la communication à la Commission des projets d'investissement d'intérêt communautaire dans les secteurs du pétrole, du gaz naturel et de l'électricité (refonte des règlements 1056/72 et 1215/76); b) le rapport de la Commission concernant une révision de la législation communautaire en matière d'énergie, et la communication de la Commission concernant l'abrogation de plusieurs textes législatifs communautaires (trois règlements et cinq recommandations) dans le secteur de la politique énergétique.

III. RECALLS that, in view of the specific institutional, legislative and contractual characteristics of each Member State, Community action should concentrate on setting objectives, leaving it to the Member States to choose the means most appropriate to their situation, within a commonly defined general framework, CONSIDERS it necessary to step up action in favour of SMEs to improve and simplify the legislative and administrative environment, and is therefore in favour of consultation between Member States on the basis of continual exchange of experience, with the assistance of the Commission and organized within the framework of a Committee consisting in particular of representatives of the Member States, Particularly WELCOMES the Commission's continued efforts in parallel to simplify current Community legislation and its intention to set up a group of independent experts charged with re-examining the effects of existing Community and national legislation on employment and competitiveness with the aim of reducing legal and administrative constraints on enterprises, CONSIDERS also that it is necessary to extend cooperation between the Member States and the Community to include exchange of experience and best practice regarding enterprise-support measures in a competitive economy for small and medium-sized enterprises, including micro- enterprises and the craft sector and concerted action to stimulate demand for services offered to enterprises, CONSIDERS it appropriate to concentrate on the three key stages in the life of an enterprise, i.e. creation, growth and transfer, CONSIDERS that policies should take account of the difficulties of the craft sector and micro-enterprises in particular, having regard to the major contribution they make to job-creation.
SOULIGNE la nécessité de veiller à la cohérence entre les dispositions nationales et communautaires. III. RAPPELLE que, en raison des spécificités institutionnelles, législatives ou contractuelles propres à chaque Etat membre, l'action de la Communauté doit se concentrer sur la définition d'objectifs, en laissant aux Etats membres le choix des moyens adaptés à leur situation respective, à l'intérieur d'un cadre général défini en commun. ESTIME nécessaire le renforcement des actions en faveur des PME visant à l'amélioration et à la simplification de l'environnement législatif et administratif, et soutient de ce fait une consultation entre Etats membres fondée sur un échange d'expériences permanent avec l'assistance de la Commission et organisé dans le cadre d'un Comité composé notamment de représentants des Etats membres. SE FELICITE tout particulièrement de ce que, parallèlement, la Commission poursuit ses efforts en vue de simplifier la législation communautaire actuelle et qu'elle a l'intention de créer un groupe d'experts indépendants chargés de réexaminer les incidences de la législation communautaire et nationale actuelle sur l'emploi et la compétitivité, en vue d'alléger les charges légales et administratives pesant sur les entreprises: ESTIME également nécessaire d'étendre la coopération entre Etats membres et Communauté à un échange d'expériences et de meilleures pratiques en matière de mesures de soutien dans une économie concurrentielle aux petites et moyennes entreprises, y compris aux micro- entreprises et à l'artisanat et à une action de concertation en matière de stimulation de la demande de services offerts aux entreprises. CONSIDERE qu'il convient de se concentrer sur les trois moments-clés dans la vie de l'entreprise, à savoir la création, la croissance et la transmission.

The Commission has already taken or is in the process of taking the following measures: - wider consultations before presenting proposals, in particular publication of Green or White Papers on the topics listed in the 1993 legislative programme; - flagging in the legislative programme of upcoming proposals which would appear to be suitable for wide-ranging preliminary consultations; - introduction of a notification procedure, consisting of the publication in the Official Journal of a brief summary of any measure planned by the Commission, with the setting of a deadline by which interested parties may submit their comments; - publication of work programmes and legislative programmes in the Official Journal to publicize action planned by the Commission; - finalization of the work programme by October with a view to enhancing openness; - publication in the legislative programme of plans for the consolidation of Community legislation; - provision of easier public access to documents held by the Commission with effect from 1 January 1994; - improving knowledge of existing databases and their accessibility, including improving the existing relay network; - publication each week in the Official Journal of lists of documents on general topics; wider public access to documents on specific topics; - preparation of an interinstitutional yearbook giving details of each institution's organization chart; - faster publication of Commission documents in all Community languages; - adoption of a new information and communication policy occupying a larger place in Commission activities; enhanced co-ordination of information activities both inside and outside the Commission; - adoption of additional measures to facilitate the general public's understanding of Commission business, in particular by making available the necessary resources and equipment to provide a suitable response to requests from the media; - improvement in the treatment of telephone, mail and personal ...
