Moreover, the argument that, if the position in question has already been filled when the action is brought, an unsuccessful candidate’s application for annulment of the decision rejecting his application will be admissible only if he also seeks annulment of the decision to appoint another candidate to that position would have the effect of introducing a condition for the admissibility of actions concerning the legality of acts adversely affecting officials brought under Article 90(2) of the Staff Regulations which is not laid down in those regulations: there is no requirement under Article 91 of the Staff Regulations (which relates to actions brought by officials before the Courts of the European Union against acts adversely affecting them) or indeed in any other legislation, that, in order for his action to be admissible, a candidate who has been unsuccessful in a selection procedure must necessarily direct that action against both the decision rejecting his application and the corresponding decision to appoint another candidate.

the European approach to collective redress must be founded on the opt-in principle, whereby victims are clearly identified and take part in the procedure only if they have expressly indicated their wish to do so, in order to avoid potential abuses; underlines the need to respect existing national systems, in accordance with the principle of subsidiarity; calls on the Commission to consider a system which will provide relevant information to all potential victims involved, increase the representativeness of collective actions, allow for the largest number of victims to seek compensation and ensure simple, affordable and effective access to justice for EU citizens, thereby avoiding excessive litigation and subsequent unnecessary individual or collective actions concerning the same infringement; calls on the Member States to put in place efficient mechanisms ensuring that as many victims as possible are informed and made aware of their rights and obligations, in particular when they are domiciled in several Member States, whilst avoiding unduly harming the reputation of the party concerned, in order to respect the principle of the presumption of innocence;

At the Commission's initiative, up to 7 % of the Fund's available resources may be used to finance transnational actions or actions of interest to the Community as a whole (hereinafter referred to as ‘Community actions’) concerning return policy and measures applicable to the target groups as referred to in Article 7.
