The European Parliament and the Council have agreed to change the EU's anti-dumping and anti-subsidy legislation following a proposal from the European Commission from November 2016.

The measures currently in force are a definitive anti-dumping duty imposed by Council Implementing Regulation (EU) No 102/2012 (5) following an expiry review pursuant to Article 11(2) of the basic Regulation, under which, inter alia, imports into the European Union of the product under review consigned from the Republic of Korea are subject to a definitive anti-dumping duty of 60,4 %, with the exception of the product manufactured by companies which have been exempted.

The institutions of the European Union failed to inform the applicants before the contested regulation was finalized and sent to the Council for adoption, about the new facts and considerations underlying the change in the anti-dumping duty and did not provide the applicants any opportunity to present new arguments or to clarify the previously provided information which could have led to a further reduction of the anti-dumping duty.
