Where any new exporting producer in the People's Republic of China provides sufficient evidence to the Commission that: (a) it did not export to the Union the product described in paragraph 1 in the period between 1 July 2009 and 30 June 2010 (original investigation period), (b) it is not related to any exporter or producer in the People's Republic of China which is subject to the anti-dumping measures imposed by this Regulation, (c) it has actually exported to the Union the product concerned or it has entered into an irrevocable contractual obligation to export a significant quantity to the Union after the end of the original investigation period, the Commission may amend the Annex I by adding the new exporting producer to the cooperating companies not included in the sample of the original investigation and thus subject to the weighted average duty of not exceeding 56.9 %.
4. 5. An anti-dumping duty shall be imposed in the appropriate amounts in each case, on a non-discriminatory basis on imports of a product from all sources found to be dumped and causing injury, except for imports from those sources from which undertakings under the terms of this Regulation have been accepted.

- 2 - As a result of the investigation, which covered the period from 1 January to 31 July 1987, it transpired that all these firms except Brother Industries .the two criteria for action under the new anti-dumping Regulation, namely: - they had begun their operations in the Community after the opening of the anti-dumping investigation, - they used a very high proportion of components ranging on average from 75% to 96% from the Japanese companies which were the subject of the original anti-dumping duty. Accordingly the Commission is proposing to the Council that anti- dumping duties should be imposed on the products manufactured by these firms, set at the following levels for each assembled part: - Canon Bretagne (France) 44.00 ECU - Kyushu Matsushita (UK) 40.94 ECU - Sharp (UK) 21.82 ECU - Silver Reed (UK) 56.14 ECU However, for Brothers industries UK the investigation snowed that on average less than 60% of the parts used came from Japan and therefore an anti-dumping duty could not be imposed.
