The evaluation mechanism consists of the following elements: multiannual and annual evaluation programmes, announced and unannounced on-site visits carried out by a small team of Commission representatives and of experts designated by Member States, reports on the outcome of the evaluations adopted by the Commission and recommendations for remedial action adopted by the Council on a proposal from the Commission, appropriate follow-up, monitoring and reporting.

Notes that the Commission, as announced in its above-mentioned Communication of 5 September 2007 , has, in the annual report under review, described the priority actions it intends to pursue in certain areas of complaint and infringement management; welcomes the statements according to which priority will continue to be given to "problems having a wide-ranging impact on fundamental rights and free movement" ; stresses the importance of urgent and determined action in these fields, as acts of violence related to racism and xenophobia have become frequent in certain Member States; equally welcomes the priority given to "infringements where citizens are on a significant scale or repeatedly exposed to direct harm or serious detriment to their quality of life" ; calls on the Commission to speed up the resolution and, where appropriate, closure of those infringement procedures that prevent Member States from investing in infrastructures that could affect the implementation of the European Economic Recovery Plan; calls on the Commission to provide the parliamentary committees responsible with a detailed plan setting out the time-limits and deadlines for the specific actions it intends to launch in these areas;
4. prend acte de ce que la Commission, comme elle l'avait annoncé dans sa communication précitée du 5 septembre 2007 , a procédé dans le rapport annuel examiné à une illustration des actions prioritaires qu'elle entend mener dans des secteurs déterminés dans la gestion des plaintes et des infractions; accueille favorablement les déclarations selon lesquelles une priorité continuera d'être accordée aux "problèmes dont les retombées sont considérables pour les droits fondamentaux et la libre circulation" ; souligne l'importance que cela revêt de mener d'urgence une action résolue dans ces domaines, les actes de violence liés au racisme et à la xénophobie se faisant de plus en plus fréquents dans certains États membres; se félicite par ailleurs de la priorité donnée au problème des "infractions qui entraînent un préjudice direct important ou répété pour les citoyens, ou qui compromettent gravement leur qualité de vie" ; invite la Commission à accélérer le traitement et, le cas échéant, la clôture des procédures en infraction qui empêchent les États membres d'investir dans des infrastructures qui pourraient affecter la mise en œuvre du plan européen de relance économique; demande à la Commission de fournir aux commissions parlementaires compétentes un plan détaillé comportant des délais et des échéances pour les actions spécifiques qu'elle entend mener dans ces secteurs;

26. Regrets that the Commission did not respect its commitment, announced in its 2002 Communication on “Better monitoring of the application of Community law”, that “the application of the priority criteria will be assessed annually, when the report on the monitoring of the application of Community law is discussed”; welcomes its new commitment to “describe and explain its action on these priorities in its annual reports, from 2008”;
