Regulation (EU) No 576/2013 of the European Parliament and of the Council lays down the animal health requirements applicable to the non-commercial movements of pet animals listed in Annex I thereto, and amphibia are included in the animals listed in that Annex.

In order to ensure the proper application of this Regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of species-specific requirements for the marking of pet animals of the species listed in Part B of Annex I and species-specific preventive health measures against diseases or infections other than rabies affecting the species listed in Annex I, as well as to adopt rules for limiting the number of pet animals of the species listed in Part B of Annex I accompanying their owner during non-commercial movement and to amend Annexes II to IV. It is of particular importance that the Commission carry out appropriate consultations during its preparatory work, including at expert level. The Commission, when preparing and drawing up delegated acts, should ensure simultaneous, timely and appropriate transmission of relevant documents to the European Parliament and Council.
Aux fins de la bonne application du présent règlement, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne, en ce qui concerne les exigences de marquage des animaux de compagnie des espèces répertoriées à l’annexe I, partie B, qui sont spécifiques à certaines espèces et les mesures sanitaires qui, en fonction des espèces, doivent être prises pour prévenir des maladies ou infections autres que la rage auxquelles sont sensibles les espèces répertoriées à l’annexe I, ainsi que l’adoption de règles visant à limiter le nombre d’animaux de compagnie des espèces répertoriées à l’annexe I, partie B, accompagnant leur propriétaire lors de mouvements non commerciaux, et la modification des annexes II à IV. Article 7 of Implementing Decision 2014/709/EU, providing for a derogation from the prohibition on the dispatch of consignments of animal by-products from porcine animals from the areas listed in Parts III and IV of the Annex to that Implementing Decision, should be reviewed in order to allow for a safe disposal of animal by-products of porcine origin other than feral pigs, including unprocessed bodies of dead animals, from holdings located in the areas listed in Part III of the Annex in a manner that is in line with the risk represented by these animal by-products.

As regards Regulation (EC) No 998/2003, the Commission should be empowered to amend the list of species of animals set out in Part C of Annex I and the lists of countries and territories set out in Parts B and C of Annex II, draw up specific requirements in respect of diseases other than rabies with regard to Member States and territories listed in section 2 of Part B of Annex II, adopt conditions applicable to the movement of animals of the species listed in Part C of Annex I from third countries and adopt requirements of a technical nature in respect of the movement of animals of the species listed in Parts A and B of Annex I. Since those measures are of general scope and are designed to amend non-essential elements of that Regulation, inter alia, by supplementing it with new non-essential elements, they must be adopted in accordance with the regulatory procedure with scrutiny provided for in Article 5a of Decision 1999/468/EC.

From then onwards the Member States will be bound to apply the amendments, the object of which is to adapt the said Annexes to the latest scientific and technological knowledge. They are as follows: - the list of cases in which bentonite-montmorillonite may be mixed with other substances, without risk of interaction, has been extended; - the use of perlite as an anti-caking agent is authorized; - Annex I has been amended to allow the use of certain iron and copper compounds for denaturing skimmed milk powder for feeding to animals other than young calves; - the period of authorization for the growth promoter nitrovin in Annex II has been extended for a specified period; - maduramycin ammonium is authorized provisionally at national level; - virginiamycin and flavophospholipol are authorized throughout the Community; - substances listed in Annex II, thus authorized at national level, are to be maintained for a specified period.
