In response to (e), in consultation with stakeholders, the CFIA has been examining possible enhancements to the Health of Animals Regulations, specifically Part XII which is related to the humane transportation of animals. The stakeholder input received to date, which includes response from a wide range of producer organizations, processors, transporters, animal welfare organizations, and the general public, indicates that there is agreement that the regulations should be reviewed and updated to reflect modern industry transportation standards and practices, as well as current scientific knowledge about animal transportation.

Points out that, in practice, the EC rules on the transport of animals (Regulation (EC) No 1/2005 and Directive 95/29/EC ) are frequently disregarded, particularly in regard to the requirements to rest,, water and feed the animals; calls, therefore, upon the Council and the Commission to take appropriate action in order to ensure that the Member States increase the number and the effectiveness of the checks carried out on the application of EC rules;

(13) In addition, in order to prevent risks arising from wild animals, carcasses or parts of carcasses of such animals suspected of being infected with a transmissible disease should be subject to the rules laid down in this Regulation. This inclusion should not imply an obligation to collect and dispose of bodies of wild animals that have died or that are hunted in their natural habitat.

As the scope of the Regulation is now being interpreted in such a way as to cover the treatment of all animal by-products (including manure and even milk processing and milk residues), whereas Parliament in fact only wished to include material obtained in slaughterhouses, its scope should be expressly clarified (namely applying to animal by-products obtained in slaughterhouses). The wide interpretation given to the definition of the term 'animal by-products' in Regulation (EC) No 1774/2002 (products 'not intended for human consumption') is in reality leading to treatment in accordance with the provisions of that Regulation being demanded even in the case of feed products (e.g. milk powder).

The Health of Animals Regulations provide for the forfeiture of animals that have been imported in contravention of the Health of Animals Act or its regulations, and for their removal from Canada where an inspector or officer has reasonable grounds to believe that this is the case or that the animals carry disease.

While the trial judge and the Court of Appeal each took note of the fact that the breach of a condition of a permit was made a contravention of the Health of Animals Regulations by the operation of sections 10(1)(a) and 160.1 of those Regulations, both failed to consider the question of whether the Health of Animals Act authorized the making of regulations deeming a contravention of the conditions of a permit to be a contravention of the regulations.
