The Commission should adopt immediately applicable implementing acts updating the list of Member States or parts thereof, with equivalent favourable status with regard to rabies, that are authorised to conclude mutual agreements to derogate from certain conditions applicable to the non-commercial movement of pet animals and the list of territories or third countries established for the purpose of derogating from certain conditions applicable to non-commercial movement, and regarding safeguard measures in the event of the occurrence or spread of rabies or of a disease or infection other than rabies, where, in duly justified cases, related to animal and public health, imperative grounds of urgency so require.
La Commission devrait adopter des actes d’exécution immédiatement applicables actualisant la liste des États membres ou parties d’États membres dont le statut au regard de la rage est favorable et qui sont autorisés à conclure des accords réciproques pour déroger à certaines conditions applicables aux mouvements non commerciaux des animaux de compagnie et la liste des territoires ou des pays tiers établie aux fins de la dérogation à certaines conditions applicables aux mouvements non commerciaux, et concernant des mesures de sauvegarde en cas d’apparition ou de propagation de la rage ou d’une maladie ou infection autre que la rage, lorsque, dans des cas dûment justifiés, liés à la santé animale ou publique, des raisons d’urgence impérieuses l’exigent.

In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission with respect to the list of Member States or parts thereof that have equivalent favourable status with regard to rabies and that are authorised to conclude mutual agreements to derogate from certain conditions applicable to the non-commercial movement of pet animals, the list of Member States categorised in accordance with the rules concerning preventive health measures against diseases and infections other than rabies, the lists of territories and third countries established for the purpose of derogating from certain conditions applicable to non-commercial movement, the model for the identification documents that are to accompany pet animals of the species listed in Annex I during non-commercial movement into a Member State from another Member State or from a territory or a third country, the rules on the format, layout and languages of the declarations to be signed, and the safeguard measures in the event of the occurrence or spread of rabies or of a disease or infection other than rabies.
Afin d’assurer des conditions uniformes d’exécution du présent règlement, il convient de conférer à la Commission des compétences d’exécution en ce qui concerne la liste des États membres ou parties d’États membres dont le statut au regard de la rage est favorable et qui sont autorisés à conclure des accords réciproques pour déroger à certaines conditions applicables aux mouvements non commerciaux des animaux de compagnie, la liste des États membres classés conformément aux règles relatives aux mesures sanitaires de prévention de maladies et d’infections autres que la rage, les listes des territoires et des pays tiers établies aux fins de la dérogation à certaines conditions applicables aux mouvements non commerciaux, le modèle des documents d’identification destinés à accompagner les animaux de compagnie des espèces répertoriées à l’annexe I lors des mouvements non commerciaux à destination d’un État membre depuis un autre État membre ou depuis un territoire ou un pays tiers, des règles concernant la forme et la présentation des déclarations à signer, ainsi que les langues utilisées dans ces déclarations et les mesures de sauvegarde en cas d’apparition ou de propagation de la rage ou d’une maladie ou infection autre que la rage.

(10) The Report from the Commission of 25 January 2005 on the possibility of introduction of EID for bovine animals concluded that it had been demonstrated that radio frequency identification had been developed to the extent that it could already be applied in practice.

If, in cases involving third countries which have concluded equivalence agreements with the Community, the Commission, after making enquiries of the competent authorities of the third countries concerned, concludes that they have failed to fulfil their obligations and the guarantees given by the plans referred to in Article 29(1), it shall cease to allow the country concerned, under the regulatory procedure referred to in Article 33(2), to benefit from the said agreements for the animals and products in question until that third country has made good its shortcomings. The suspension shall be revoked under the same procedure’.

On 26 November 2003, the European Food Safety Authority (EFSA) adopted an opinion on ‘Tuberculosis in bovine animals: risks for human health and control strategies’, which concludes that efficient post-mortem examination of specified lymph nodes and of the lungs represents an important element of national bovine tuberculosis eradication programmes, as well as being an integral part of veterinary meat inspection programmes aimed at the protection of human health.
