16 (1) Where a person imports into Canada any animal, animal product, animal byproduct, animal food or veterinary biologic, or any other thing used in respect of animals or contaminated by a disease or toxic substance, the person shall, either before or at the time of importation, present the animal, animal product, animal by-product, animal food, veterinary biologic or other thing to an inspector, officer or customs officer who may inspect it or detain it until it has been inspected or otherwise dealt with by an inspector or officer.

41.1 (1) Despite section 41, a person may import into Canada an animal by-product or a thing containing an animal by-product, other than one described in section 45, 46, 47, 47.1, 49, 50, 51, 51.2 or 53, if an inspector has reasonable grounds to believe that the importation of the by-product or thing, by its nature, end use or the manner in which it has been processed, would not, or would not be likely to, result in the introduction into Canada of any reportable disease, any disease referred to in Schedule VII and any serious epizootic disease to which the species from which the by-product was derived is susceptible and that can be transmitted by the by-product, and the by-product or thing is not intended for use as animal food or as an ingredient in animal food.

34.1 (1) Notwithstanding subsections 34(1) and (2), a person may import an animal product referred to therein if the person produces a document that shows the details of the treatment of the animal product and the inspector is satisfied, based on the source of the document, the information contained in the document and any other relevant information available to the inspector and, where necessary, on an inspection of the animal product, that the importation of the animal product into Canada would not, or would not be likely to, result in the introduction into Canada, or the spread within Canada, of a vector, disease or toxic substance.

(j) for declaring as infected, and constituting as an infected place, any airport, market, pen, railway yard, stockyard, conveyance or wharf on or in which any animal, animal product, animal by-product, animal food, hay, straw or fodder, or any other thing used in respect of animals, is exposed for sale or is placed for the purpose of transit;

At the same time, within the individual chapters of the Regulation, the list of the categories of costs that are potentially eligible for funding is extended to include, amongst others: compensation to operators for the value of their animals slaughtered or culled; compensation to operators for the value of any plants and plant products destroyed; compensation for the relevant transport and logistical costs and for other specific measures designed to prevent the further spread of diseases and/or pests.

Possibilities for substituting imported soybeans and other non-domestically produced animal feed products strongly depend upon new incentives for farmers to grow these crops and on adequate infrastructure for processing into animal feed. The European Commission should therefore look into possibilities to overcome the current low level of research, seed selection and marketing, knowledge of production, storage and use of these crops for on-farm feed production.

This is the view of the Commissionand its food safety advisers. This view appears to be supported by all other health authorities and experts, including the Committee on Fisheries of the Food and Agriculture Organisation (UN) which has stated that “There is no epidemiological evidence for BSE being transmitted to ruminants or other animals by fishmeal. Similarly there is not epidemiological evidence for transmission to humans of a variant CJD caused by prions that used fish or fish products as vectors” (FAO Fisheries Report No 673 page 12).
