The Commission makes an important reference to the Google Books Settlement reached in 2008/2009 between Google and the Authors' Guild and the Association of American Publishers, which would allow Google to use most orphan works without any prior permission and display them online in the United States, this putting Europe far back in terms of competitiveness and access to human heritage.

This settlement is an agreement between Google and the Association of American Publishers and the Authors’ Guild to settle a legal action for breach of copyright.
