1. In the absence of clear indications to the contrary, a contract, concluded before [insert date before which Member States are to transpose the amending directive, as mentioned in Article 2 below], whereby a performer has transferred or assigned his rights in the fixation of his performance to a phonogram producer (hereinafter: a "contract on transfer or assignment"), shall be deemed to continue to produce its effects beyond the moment at which, by virtue of Article 3 (1) and (2) in their version before amendment by Directive [// insert: Nr. of this amending directive], the performer and the phonogram producer would be no longer protected in regard of, respectively, the fixation of the performance and the phonogram.

2. Paragraphs 3 to 6 of this article shall apply to contracts on transfer or assignment which continue to produce their effects beyond the moment at which, by virtue of Article 3 (1) and (2) in their version before amendment by Directive [// insert: Nr. of this amending directive]/EC, the performer and the phonogram producer would be no longer protected in regard of, respectively, the fixation of the performance and the phonogram.

3. Where a contract on transfer or assignment gives the performer a right to claim a non recurring remuneration, the performer shall have the right to obtain an annual supplementary remuneration from the phonogram producer for each full year in which, by virtue of Article 3 (1) and (2) in its version before amendment by Directive [// insert: Nr. of this amending directive]/EC, the performer and the phonogram producer would be no longer protected in regard of, respectively, the fixation of the performance and the phonogram.

4. The overall amount to be dedicated by a phonogram producer to payments of the supplementary remuneration referred to in paragraph 3 shall correspond to at least 20 percent of the revenues which he has derived, during the year preceding that for which the said remuneration is paid, from the reproduction, distribution and making available of those phonograms in regard of which, by virtue of Article 3 (1) and (2) in their version before amendment by Directive [// insert: Nr. of this amending directive]/EC, the performer and the phonogram producer would be no longer protected on 31 December of the said year.
4. Article 2 of the original Regulation stipulates that where any new exporting producer in India provides sufficient evidence to the Commission that it did not export to the Community the products described in Article 1(1) of that Regulation during the investigation period (1 October 2001 to 30 September 2002) (the first criterion), that it is not related to any of the exporters or producers in India which are subject to the anti-subsidy measures imposed by that Regulation (the second criterion) and that it has actually exported to the Community the products concerned after the investigation period on which the measures are based, or that it has entered into an irrevocable contractual obligation to export a significant quantity of the product concerned to the Community (the third criterion), then Article 1(3) of that Regulation may be amended by granting the new exporting producers the duty rate applicable to the cooperating companies not included in the sample, i.e. 7,6 %.
L’article 2 du règlement initial dispose que, lorsqu’un nouveau producteur-exportateur en Inde fournit à la Commission des éléments de preuve suffisants pour établir qu’il n’a pas exporté vers la Communauté les produits visés à l’article 1er, paragraphe 1, dudit règlement, au cours de la période d’enquête (du 1er octobre 2001 au 30 septembre 2002) («la période d’enquête») (premier critère), qu’il n’est lié ni à un exportateur ni à un producteur en Inde soumis aux mesures compensatoires instituées par ce règlement (deuxième critère) et qu’il n’a exporté le produit concerné vers la Communauté qu’après la période d’enquête sur laquelle les mesures sont fondées ou qu’il a souscrit une obligation contractuelle et irrévocable d’exportation d’une quantité importante du produit concerné vers la Communauté (troisième critère), alors l’article 1er, paragraphe 3, du règlement peut être modifié de manière à accorder au nouveau producteur-exportateur le taux de droit applicable aux sociétés ayant coopéré non incluses dans l’échantillon, soit 7,6 %.

Without prejudice to any future amendments, producers whose tobacco production quotas were bought back during the 2002 and 2003 harvests in accordance with Article 14 of Regulation (EEC) No 2075/92 shall be entitled as from 1 January 2006, for the remainder of the five harvest years following the year in which their quota is bought back, to receive an amount equal to a percentage of the premium granted in respect of the 2005 harvest, as shown in the tables in Annex XXX. These amounts shall be paid before 31 May each year.

In order to better ensure a fair standard of living for the agricultural community in regions where bananas are produced, to better direct resources towards market-orientation of producers, to stabilise expenditure, to ensure respect of the international obligations of the Community, to take adequately into account the particularities of the producing regions, to simplify the management of the regime and align it on the principles of the reformed common market organisations, it is necessary to amend this regime.
Afin de mieux garantir un niveau de vie équitable pour la population agricole dans les régions de production des bananes, de mieux orienter les ressources pour faciliter l’adaptation des producteurs à la logique du marché, de stabiliser les dépenses, d’assurer le respect des obligations internationales de la Communauté, de prendre en compte de manière adéquate les particularités des régions productrices, de simplifier la gestion du régime et de l’harmoniser avec les principes des organisations communes de marchés réformées, il est nécessaire de modifier ce régime.
