Since the provisions of the Financial Regulation and the rules of implementation are closely linked, the Court of Auditors considers that it should be informed about the amendments which the Commission proposes to the rules of application before the legislator adopts the rules amending the Financial Regulation.

The applicant claims in that regard that, in tersely confirming in the contested decision that the error in the title of the amending decision of 31 December 2012 had no effect on the content of the decision itself or on the implementation of the programme, the Commission neglected to take into consideration the relevance of the following circumstances: (i) the spending decisions adopted by the Region had to be checked beforehand by the Court of Auditors; (ii) four months had elapsed between the correction being announced and the correction being implemented, without any explanation being provided; (iii) that fact had the potential to arouse the suspicion that the correction to be made was of greater importance than a correction supposedly relating only to the title of the decision of 31 December 2012; and (iv) the Court of Auditors had confirmed that the course of action taken by the Region, which refrained from adopting the commitments until the correction was officially recognised (28 March 2013), was correct, thus giving it to be understood that the opposite course of action would not have been correct.

It is necessary to amend Decision 2009/496/EC, Euratom of the European Parliament, the Council, the Commission, the Court of Justice, the Court of Auditors, the European Economic and Social Committee and the Committee of the Regions of 26 June 2009 on the organisation and operation of the Publications Office of the European Union (1) in order to adapt it to the provisions of the Treaties as amended by the Treaty of Lisbon and, in particular, to add the European Council as a signatory institution.

That is why I am very pleased today to introduce bill C-277, an act to amend the Auditor General Act (audit of accounts), in order to allow the Auditor General to act as auditor or joint auditor, firstly, of crown corporations; secondly, of certain other bodies established by acts of Parliament to which the Government of Canada has paid at least $100 million during any period of 12 consecutive months; and, thirdly, of certain corporate entities without share capital in respect of which the Government of Canada has, either directly or through a crown corporation, the right to appoint or nominate a member of the governing body, andto which the Government of Canada has paid at least $100 million in money or in kind during any period of 12 consecutive months.

With a view to rendering the relationship between the statutory auditor or audit firm and the audited entity more transparent, Directives 78/660/EEC and 83/349/EEC should be amended so as to require disclosure of the audit fee and the fee paid for non-audit services in the notes to the annual accounts and the consolidated accounts.

On the one hand, Regulation 1292/2004 (3) amended Regulation No 422/67/EEC, 5/67/Euratom of the Council of 25 July 1967 determining the emoluments of the President and members of the Commission and of the President, Judges, Advocates-General and Registrar of the Court of Justice and of the President, Members and Registrar of the Court of First Instance (4), and, on the other hand, the Council Regulation 1293/2004 (5) amended Council Regulation (EEC, Euratom, ECSC) No 2290/77 of 18 October 1977 determining the emoluments of the members of the Court of Auditors (6).

I should explain that the impetus for that amendment, the one that amends the Auditor General Act, is a direct result of a letter that the Auditor General wrote to me asking that we make that amendment, please, in order to correct an oversight in the situation that I described earlier: If the commissioner were to report to Parliament today and something that the commissioner thought was really important arose tomorrow, he or she could not report to Parliament on that matter for a year, without this amendment.
