The proposed Directive, which will amend, inter alia, the EIA Directive so as to transpose the Aarhus Convention into EU legislation, will require Member States to ensure that the public concerned (subject to certain conditions) has access to a review procedure before a court of law or another independent and impartial body established by law to challenge the substantive or procedural legality of decisions, acts or omissions that are subject to the public participation provisions of the EIA Directive (Article 10a).
